TOWN ADMINISTRATOR // SELECTMEN REPORTS

Mr. McDevitt, Mr. Lynde a= nd Mr. Viger had no reports.

Mr. Gaydos received commu= nication from Pennichuck, not only about moving the water line to accommodate the ro= und about, but they were also thinking about replacing the water main that ran = down Sawmill Road= . He indicated that it would be a wonderful improvement given that it was an aging line. He said they were investigating th= e cost of having it done at the same time.

Mr. Gleason commented tha= t the Town had been approached about bringing natural gas into Pelham. If it comes to fruition, water and natural gas would be a good asset for the Town and its future economic grow= th. He reported that the Senior’s Valentine Breakfast that hosted the Town employees, elected officials and volunteers was held earlier in the day.&nb= sp; He said everyone that went had a great time. He said they also participated in = the ribbon cutting opening at Enterprise Bank.= He was impressed with the amount of people that showed up. He noted the Town would welcome the Southern New Hampshire Medical Center in the Spring. Mr. Gleason made the public aware = that thanks to the efforts of Representative Shaun Doherty, the House had voted to name= the Main Street Bridge after Sergeant Daniel Gionet, who had been killed in action in Iraq. He stated that a letter had been s= ent to Governor Lynch requesting that he veto the legislation on redistricting whi= ch precluded Pelham from having local representation. He was told by Representative Dohe= rty that he discussed the issue with the Governor and he may call the Selectmen= to discuss the matter further. M= r. Gleason noted that there was an effort by Representative Beverly Ferrante (Rockingham) to introduce House Bill 1561, which would discontinue Regional Planning Commission. He said = they had some vocal opposition to such and believed the Selectmen would take opposition to such as well. H= e said the Selectmen recognize the importance of Nashua Regional Planning Commissi= on in terms of helping the Town with various studies (i.e. traffic, conservati= on) and other activities.

APPOINTMENTS

PUBLIC HEARING: 2nd of two hearings regarding a proposal to purchase property of approximately = 14 acres on Hinds Lane, located at Tax Map 20 Lots 2-113-2 and 2-113-3. These lots, if acquired, will be f= or use as conservation land.

Conservation Chairman Pau= l Gagnon came forward to discuss the proposal to purchase property (14 acres) on Gum= pas Pond. He summarized the infor= mation covered during the first hearing. There are two parcels (3 acres and 11 acres) both of which abut the 155 acre Gump= as Pond Conservation area. The p= urchase price is $200,000. Two import= ant points from a conservation perspective are that they protect almost 1200 li= near feet of Hinds Lane and would have a 15ft. pedestrian easement to Gumpas Pond.

Mr. Gleason asked what recommendation the Conservation Commission had for the Selectmen. Mr. Gagnon replied that the Conser= vation Commission reviewed the proposal and voted in favor of the acquisition.

Mr. Gleason opened the di= scussion to the public for input.

Ms. Wendy Smigelski, 12 Lox Lane= , an Officer of the Gumpas Gumpas Pond Association came forward to speak to the Selectmen. As discussed durin= g the site walk, she got in touch with the association, held a meeting and heard their concerns and recommendations. An unsigned letter (dated February 12, 2012) was provided to the Selectmen lis= ting out what was discussed during the association meeting; a formal signed copy would be submitted when the President of the association returned from vacation. She believed the it= ems on the list have been discussed; some items would be easily fixed, some will n= eed discussion. They were more th= an willing to meet half way on some of the items. Ms. Smigelski read the letter aloud. The following concerns= were noted:

1)&n= bsp;      pedestrian traffic only;

2)&n= bsp;      allowable watercraft being canoes, kayaks, nothing larger than a small electric trolling motor, no trailers, no jet skis;

3)&n= bsp;      if a trolling motor is brought in it must be cleaned before accessing Gumpas Pond and recommend cleaning after in order to limit= the transport of invasive aquatic weeds into and out of Gumpas Pond;

4)&n= bsp;      no docks, raft, beach or swimming;

5)&n= bsp;      no mooring of boats off shore or stored on shore; <= /p>
6)&n= bsp;      a trash in / trash out policy;

7)&n= bsp;      if a parking area is created across the street, it shall be no more than three to four cars and street parking is limited to property owners and not Town residents accessing this pedestrian path;

8)&n= bsp;      limit the hours from dawn to dusk;

9)&n= bsp;      Town residents only identified by a vehicular stick= er (perhaps even the Pelham Recycling sticker);

10)&= nbsp; no parties or fires on the path, parking lot or pri= vate property surrounding the pond;

11)&= nbsp; any and all improvements to that 15ft. path must be after discussions and agreement with Keith and Kathy Regan, who are the property owners;

12)&= nbsp; liability concerns must be addressed with regard to Keith and Kathy Regan and also the Pond landowners and the Gumpas Gumpas Po= nd Association (examples of those are visitors accessing from the path and go = onto someone’s property and are injured, or flip their boat, or fall off t= he dam);

13)&= nbsp; no accessing of any private property along the shoreline, including the island and the dam;

14)&= nbsp; request of a speed limit posting of 20mph along Hinds Lane;=

15)&= nbsp; request discussion on possible financial assistance with dam maintenance, repairs and state registration;

16)&= nbsp; suggestion of dealing with the lack of toilet facilities;

17)&= nbsp; identification and contact information for a depart= ment who landowners can contact in the event that there are violations of any and all items listed above.

Ms. Smigelski continued r= eading the letter which indicated the Gumpas Gumpas Pond Association was formed to= not only control the water within Gumpas Pond, but also the maintenance of the = dam and the area surrounding it, including the quality of water. The concern regarding liability was reiterated, as well as the concern for water contamination.

Mr. Keith Regan, 39 Hinds= Lane said originally it was going to be a three-lot subdivision that would have access to the foot path, then went to possible further subdivision and now possible public access. He sa= id he asked Mr. Gagnon if they could keep it to Town residents only and was told = yes they could. During the site w= alk the Selectmen were asked if they could keep it to Town residents only and t= he response was yes. He hoped th= ey kept their word and kept the access to Town residents only and restricted as much as possible.

Mr. Gagnon reviewed the l= etter from the association and felt it was quite reasonable. He was pleased to have the documen= t as a starting point and found a majority easy to agree to. Mr. Gleason said it seemed appropr= iate to have Mr. Gagnon review the conservation aspects. He said Mr. Gaydos would need to r= eview the items that affect the Town all the while working collectively to come t= o a satisfactory resolution.

Mr. Gaydos noted that in = looking at the list it had to be kept in mind that there was another property that = may, or may not share the easement. He believed the intent was to leave the path, at this time, as unimproved. He reviewed the items contained in= the letter. In regard to liability concerns, he spoke with the Town’s insurance carrier who was more than happy to give the Regans, upon the Town’s purchase of the property, a certificate of insurance saying that if someone is accessing the property (= as a Town individual) and hurt themselves, the Town would hold the Regans harmle= ss in that matter. However, the = Town would not provide insurance for the other property owner when they came in; that would be an issue for the other property owner and the Regans to deal with. He stated that the Town= could not ensure the actions of the public on private property. He continued to review the items contained in the letter and believed most things were ‘do-able’= but there were also some things that were outside of the Town’s control.<= span style=3D'mso-spacerun:yes'>

Mr. Gleason hoped that th= ose things that were difficult to address (at this time) could be taken up with= the association and work toward resolving.&nbs= p; He said if they recognize the Town’s limitations, and the Town recognizes their wishes, he was sure they could reach mutual ground. He stated the intent of the hearin= g was not to solve those problems, but to vote whether or not the Town would proc= eed with the acquisition of the property. He wanted to make sure before proceeding to vote that they had the vehicle in place that would allow them to reach consensus.

Mr. McDevitt suggested it= might be a good idea, so the residents could feel better, if the Selectmen indica= ted by consensus that they agreed with the spirit of the letter. Mr. Lynde was pleased to see the l= etter and felt it was well thought out. He reviewed the items and questioned how limitations could be put on= the right-of-way if there was another property that could access it. Ms. Smigelski came forward again a= nd noted it was not currently an issue because the President of the Association purchased the other lot. She didn’t feel the association was looking to the Selectmen to solve that problem; they understood it wasn’t the Town’s liability. They were seeking assistance and l= ooking for everyone to be ‘on the same page’. She said they had a great deal of liability generally by people that came to visit. She agreed with the Chairman and M= r. McDevitt that they would like something in writing given that boards change over the years. She said it w= as much easier for people who visit if they knew the rules prior to going to t= he place. She didn’t fores= ee a great deal of issues, they just wanted to make sure the foundation was set = so they didn’t.

It was understood that to= change the speed limit there was a high level of criteria that would have to be met. Mr. Gaydos understood th= at the road needed attention even if cars weren’t going to be put out there. He said if there were = road issues because of the conservation area, the Town would be a good neighbor.

Mr. Viger said as Mr. Gag= non brought this type of purchase in front of the Selectmen, they got excited because they saw an opportunity to connect the conservation land. He said they understood and respec= ted the opinions of the people on the pond and saw the impact of what would hap= pen if the Town didn’t purchase the land. He felt this was a work in progres= s and the more things they could identify would eliminate more problems in the future. He also felt they cou= ld work together to establish the conservation land and limit the access to the pond.

Mr. Lynde questioned if t= he intent was to limit the access on the easement to pedestrian traffic. Ms. Smigelski answered yes. She said people had it written into their easement as pedestrian traffic, but people visiting would try to fit whatever they could into the area. It was Mr. Lynde’s opinion that they make it difficult for any= body to roll something down to the pond. Ms. Smigelski commented that Mr. Gagnon has several suggestions for = ways to attain that. Mr. Lynde sai= d the comment regarding parking seemed to only apply for residents who live there= . Ms. Smigelski said the residents w= ere limited with regard to parking; if they noted ‘no street parking̵= 7; that would limit the residents as well.&nb= sp; She said the residents understood what they had to do when having company, however, visitors wouldn’t know and would create parking problems. Mr. McDevitt unders= tood the problem, but didn’t believe that parking could be limited on a pu= blic street to only the people who lived on that street. It was noted that the conservation= lot could be used by residents for additional parking.

Mr. Gleason thanked the association for coming forward with the document; it demonstrated a willing= ness to work with the Town. He fel= t the proposed acquisition was a win-win situation; it would provide additional facilities for the taxpayers and Town’s people and collaboratively wo= rking with the association, improvements could be made in the area. He applauded the efforts of the Conservation Commission.   Mr. Gleason asked if it was s= till the recommendation of the Conservation Commission that the Selectmen approve the purchase of the land. Mr. Gagnon indicated they were in favor of the land acquisition.

(McDevitt/Lynde) To support the spirit in which the letter was written and would make every effort, within constraints discussed, to accommodate that letter.

Mr. McDevitt asked that a= date be set for a public discussion. = There was a brief discussion regarding the purchase process. Mr. Gagnon said they had asked a surveyor to provide the cost for finding the 15ft. easement once they close= on the property. He said they wo= uld close on the property, find the easement and stake out the parking area. After that time (late April to May= ) they could have a discussion how they would proceed. An action item was set for a follow= up meeting.

PUBLIC HEARING: <= /span>Hearing to receive public comment on = Petition Warrant Article “Shall we ado= pt the provisions of RSA 40:14-b to delegate the determination of the default budg= et to the municipal budget committee which has been adopted under RSA 32:14?”

Mr. Gleason stated that t= here had been significant discussion regarding the article at both the Town and Scho= ol deliberative sessions.

Mr. McDevitt repeated wha= t was said at the deliberative session. = He believed it was a revelation for people that the article was not submitted = by the Budget Committee and in fact only one member of the Budget Committee si= gned the petition. He said it was = also said that the petition appeared to be a solution in search of a problem.

Mr. Viger didn’t re= call a petition warrant article having public hearings, although it may be because= of statute requirements. He ques= tioned why the Selectmen were conducting public hearings. Mr. Gaydos said the required the p= ublic hearings. Mr. Viger asked if = the hearing were required because there was a change in policy. Mr. Gaydos said it stemmed around = the adoption of SB2; because the warrant article was prescribed by statute, it couldn’t be changed.

Mr. Gleason was in opposi= tion to the warrant because the rules/requirements for establishing a default budget are very well established by state law.&nb= sp; He said the Town followed that process very well; the Selectmen had = the authority to review all items with the departments and determine what would= be an appropriate addition (to the default) based upon its existence in the previous budget. He was reluc= tant to relinquish that ability to the Budget Committee because they may not be aware of all the facts and could make a decision that was detrimental to the operation of the Town under the default budget.

Mr. Gaydos noted when the= y had a discussion at the Budget Committee, at which the Town indicated they had al= ways presented a default budget and left it transparent for them to question. In= the event there was a missed item, corrections were made. The new administration with the Sc= hool has indicated they would be more than happy to share information and prepare the default budget so that it was transparent to the Budget Committee. The School Board Representative to= the Budget Committee said if they were told what was expected, the School Board= would perform.

There was no further comment/discussion.

Proposed Fire Station Discussion: Funding /= Impact Fees / Website – www.firestationfac= ts.com

Mr. Gaydos stated there w= as a not to exceed price of $3.9 million; they believe it could come in less than th= at, if it does they will have the option of making other improvements or taking= the savings and not spending the money. He understood that the Fire Chief was working hard with regard to the design details. He said durin= g the last several years there had been discussions about bonding the station and= now that the design had been refined several times and they found there was mon= ey in the undesignated surplus to apply to the cost. Previously they didn’t see n= ot borrowing as an option. If th= e project was bonded, they would be looking at approximately $594,000 of interest (on= ly) cost over six years. Mr. Gayd= os discussed the costs associated with bonding the project that in the end wou= ld not represent a savings to taxpayers. With regard to the impact fees that were collected (approx. $423,000= of which remains approx.$220,000), it had been committed to the project and wo= uld not be given back. He believed, based on savings in certain areas of the budget, they found if everything passed on the ballot the tax rate increase would be a dollar. Mr. Gaydos= said when it first became a possibility ( use the undesignated surplus), there w= as a discussion with the Budget Committee regarding the scenario of funding the station. He said it was unani= mous amongst the Budget Committee that this was the most prudent way to pursue t= he project because it was inexpensive and approximately $600,000 of extra cost could be avoided. The money could be used for the building and not toward interest costs.

Mr. Gleason commented tha= t there was a misconception that the Town had garnered a lot of money out of the fu= nd balance, which was not the case; the money had been accumulating over the y= ears. He said the decision was made this= year to utilize that to offset the cost of the fire station. Mr. Gaydos discussed how the fund balance had been used in previous years, an example was in 2006, $750,000 w= as applied to reduce property taxes. He said the Town had a long history of taking funds and letting the fund balan= ce accumulate. Mr. Gleason reite= rated that historically the Selectmen had used the fund balance and it wasn’= ;t unreasonable to assume that if the Town was the recipients to additional funds to the fu= nd balance coming up in November 2012, that some of the money could be used to offset the tax rate again.

Mr. McDevitt pointed out = that in the last four-five years the Selectmen were really careful and that’s= how the money began to build up. = He had done research of Town Meetings at which the voters were asked to use fund balance money and noted a few of those instances. He said it wasn’t unusual fo= r the Selectmen to ask voters to use the fund balance to offset one-time expenses= ; it was getting attention in this instance because it was a big amount. Mr. Lynde stated the Selectmen had always worked to maintain a reasonable fund balance. Mr. Viger noted that for years the department heads had been held to zero/limited growth to the point that they had to absorb contractual increases within their budgets to maintain an acc= eptable tax rate. He discussed other savings measures that had been taken during the years he had been a Selectman.

Fire Chief James Midgley = discussed the construction items that were in the process of being reviewed, such as = looking at the exterior of the building, site plan, construction method (layout), a= nd detailed review of every room and every page of architectural plan (determination of any conflicting areas).&= nbsp; He informed that the informational website was up and running (www.firestationfacts.com) and had roughly = 900 hits with many being referrals from Face Book. All information contained on the w= ebsite was factual and could be confirmed. Using a projection screen he showed how the site navigation was set = up and information was sorted. T= he frequently asked questions section would continue to grow as additional questions were submitted. News articles also have a link and will be updated continually.

Mr. Gleason asked if the website had a section for local contractors to inquire= as to the opportunity to bid. Mr. Gaydos said they wouldn’t go through the bid process unless the stati= on was approved at Town Meeting. In the coming weeks a date would be advertised that would encourage local cont= ractors to obtain a copy of the plans that pertained to their skill/service so they could begin speaking to Eckman about being qualified as a bidder. After Town Meeting a meeting would= be scheduled with those people. = Mr. Gaydos said they wanted to reach out to as many local contractors as possible. <= /p>

Fire Chief Midgley encouraged people if they have a question to e-mail the fire station. They will research t= he answer and post it on the website. He said they weren’t hiding anything and wanted people to have information. Mr. Gaydos comme= nted that the website was dynamic and changed everyday.

Mr. Lynde asked if there was an approximate timeline of the steps that would be taken should the station be approved. Mr. Gaydos said it was being done now. He wanted people to understand whe= n the plans were reviewed room-by-room, one advantage of the system they were usi= ng was having everyone work together down to the smallest details to reduce the number of change orders; this work is being done prior to Town Meeting. He said the plan was once they had= the ‘go ahead’ all the documentation would be ready to go out to bid. This is one reason he wa= nted to speak to local contractors about becoming pre-qualified so they could bi= d on the project. Chief Midgley sa= id they were still finding cost savings during their detailed review.

Mr. Gleason thanked the Chief for meeting with the Selectmen. He said he had been to the website= and found it to be extremely informative and user friendly.

·         Ob= tain status regarding Young’s Crossing and the flashing sign on Route 38/Gage Hill Road/Ledge Road intersection and from Police Chief. (8/9/11 Mr. Gaydos had a discussion with Police Chief= Roark regarding the flashing light and there may be less expensive alternatives.<= span style=3D'mso-spacerun:yes'> The Chief has requested a meeting = with the DOT district for Pelham)(8/30/11 – correspondence received from State – Mr. Gaydos to work with Police Chief Roark to compile accident statistics) / 10/25/11 – Mr. Gaydos said Chief Roark was heading this up – the same type of study = is being done at the Sherburne Road intersection.; 1/17/12 – still worki= ng with intersection (with state) in conjunction with Sherburne Road.

Mr. Gaydos felt the flood study wo= uld aid in an outcome. =
