Spaulding Hill Road
Mr. Shayne Gendron of Her= bert Associates came forward to request a building permit for Map 32, Lot 1-146-= 1, which had 399ft. of frontage on Spaulding Hill Road on a section that is subject to gates and bars. Th= e lot has received State subdivision approval as well as septic design approval.<= span style=3D'mso-spacerun:yes'> Mr. Gendron reviewed the lot and explained that the Spaulding Hill Road pavement ended, however the road continued after that point. T= he proposal is to construct a 14ft. wide driveway connecting to the edge of pavement (where the pavement ended on Spaulding Hill Road) and continue alo= ng to the proposed dwelling. The= re would be approximately 350ft. of driveway.= The lot meets all other Town and State requirements and has no zoning issues.
Mr. Viger reviewed the ba= ckup information submitted by the Planning Director and requested clarification = as to the status of the road. He believed that the property would be located on a section of road that was n= ot Class V. Mr. Gendron replied = that was correct; the road is subject to gates and bars, a Class VI road. Mr. Viger questioned h= ow much of the road emergency vehicles would have to travel to get to the prop= osed property. Mr. Gendron said th= ey would travel approximately 75ft. to get onto the property.
Mr. McDevitt reviewed the proposed plan. He said it app= eared that the paved road, where it stopped (on Spaulding Hill Road) would be pav= ed further and then up the driveway. Mr. Gendron stated that was the proposal. He said it made sense to pave that portion not only for emergency vehicles but also for the owner's access out= of the lot. He said they weren't= set on paving that portion, it could remain gravel. Mr. McDevitt questioned if the Town should care whether that section was paved or not because it would be a driveway and not done to road standards.&n= bsp; He asked if the proposal in front of the Selectmen was different from that which was presented to the Planning Board. Mr. Gendron wasn't sure if the pla= n was exactly what was presented to the Planning Board.
Mr. Lynde arrived.
Mr. Gleason said the Sele= ctmen packet included a release of liability form and questioned if that was the = one to be used in the case. Mr. G= aydos answered yes. Mr. Gleason ask= ed if Mr. Gendron had read the liability form.&n= bsp; Mr. Gendron answered no; the client's attorney had reviewed the form= . Mr. Gleason questioned if Mr. Gend= ron understood the purpose of the form. Mr. Gendron answered yes; he believed it was a regular form for a wa= iver of municipal liability (emergency access etc). Mr. Gleason said the form covered responsibility for plowing and maintaining etc. Mr. Gendron said they were fully a= ware of it.
Mr. Lynde asked how the l= ot was created. Mr. Gendron believed= the lot was created by a subdivision done in the late 1990's. He didn’t recall if it was a residual left over from a larger piece or exactly how it came about. Mr. Lynde asked if the lots in back (Lots 1-143, 1-144, 1-145) had a similar situation. Mr. Gendron said Lot 1-143 had fro= ntage on a section of Class V. He w= as unsure about Lots 1-144 and 1-145 and commented they may be subject to gates and bars. He noted that Lots 1-146-7,9,10 & 11 were on= a current subdivision his office was working on with access on a new road that would come in. Mr. Lynde conf= irmed that the square footage and everything else met Town standards. Mr. Gendron answered yes. Mr. Lynde asked if the lot had sufficient area to put a leach field and replacement f= ield. Mr. Gendron stated they had an app= roved septic design. The lot contai= ned four acres and had a proposed four-bedroom home.
Mr. Haverty wanted to kno= w how the home fit with the E911 standards with it not being located on a Town road. He questioned how a num= ber would be assigned. Mr. Gaydos understood that the Assessing Department would assign an address to the lot. Mr. Haverty asked if they would adhere to the same standards on a 50-foot grid, closest to the drivew= ay etc. Mr. Gaydos answered yes,= the same standards would be used.
Mr. Lynde believed the ro= ad (Spaulding Hill) had a gate and assumed it was no longer there. Mr. Gendron wasn't aware of an act= ual gate across the road. Mr. McD= evitt said the Planning Board had a brief discussion and were told that the gate = was erected by a private party, not the Town and shouldn't be there. He said the gate had questionable legality. The term 'subject to gates and bars' didn't mean there were gates or bars.
Mr. McDevitt said his only concern was the pavement and if he was the owner, he would want to pave as well. He didn't know if the T= own would have any additional liability or concerns from allowing it.
Mr. Lynde stated he went = through a similar situation (with his home) and there was no pavement involved. He said he had to main= tain the roadway section from his property to where emergency vehicles would access. He had to hold the To= wn harmless for maintenance etc. Mr. Gendron stated that the plan was a pictorial. He said if the Board wanted, they = didn't have a problem leaving the road gravel.&nb= sp; They felt it was a nicety to have it paved to make it more accessible for everyone. Mr. Gendron com= mented they wouldn’t have a problem if the Town preferred it to remain grave= l. Mr. McDevitt said he liked the paving, but wanted to ensure it didn't incur= any issues/concerns for the municipality. He noted that the owner wanted to pave.
Mr. Viger wanted clarific=
ation
that the homeowner would be responsible for maintaining that portion of the
road (where the Class V ended) as their driveway up to the proposed home.
Mr. Haverty confirmed tha= t the road was in effect a Class VI road. Mr. Gendron said it was spelled out in the Administrative Decision a= s a public right-of-way. Mr. Have= rty confirmed that it was currently gravel.&nb= sp; Mr. Gendron answered yes. Mr. Haverty questioned who made it gravel. Mr. Gendron said it was an old car= riage road and couldn't answer who made it gravel. Mr. Haverty stated it was a Town C= lass VI road and questioned who would pave the road according to the plan. Mr. Gendron replied the owner woul= d pave the driveway. Given that the = road is a Town Class VI road, Mr. Haverty questioned if the Selectmen wanted som= eone paving the road, or if it should be left as it presently was. His position was to leave the road= alone and let the owner pave their driveway if that's what they wanted to do.
Mr. Gaydos stated that the agreement that would be signed would hereby and forever release and dischar= ge the Town, it's Officers etc. from obligation of maintaining the Class VI portion of Spaulding Hill Road from any claim of any nature. He continued to read a portion of = the release of liability agreement aloud. He didn't know why the Selectmen wouldn't approve allowing the owner= to pave because it was a discontinued road.&n= bsp; He said if the Town improved the road they would start to take owner= ship of it. In the event the owner= paved the Class VI road, Mr. Haverty wanted to know if the Town would be liable if something were to happen to someone off the owner's property. Mr. Gaydos answered no. Mr. Haverty confirmed that the own= er would be accepting liability for that stretch of Class VI road. Mr. Gaydos went back and reviewed = the liability agreement which read 'any claim of any nature' and provided situa= tion examples in which the Town would not be liable. Mr. Gleason noted that the paved p= ortion was really becoming an extension of the owner's driveway.
Mr. McDevitt believed the agreement should contain language that granted the owner permission to pave, and not just show it on the plan.

would become private once it was established. Mr. Gaydos answered no; it was sti=
ll a
Class VI road. The agreement
indicated that the owner had no right to prohibit public use of the road.
Mr. Haverty recognized th= at the road was currently a gravel carriage road, but wondered who would maintain = the driveway all the way to the Class V road once it was in place for a number = of years. He felt the Town was b= etter off leaving the Class VI road as it presently was. He said if the owner wanted a paved driveway, they could have it starting at the property line up to their home.
Mr. Gleason said a recomm= endation was made by Mr. McDevitt to grant the owner authority to pave it. He said if Mr. Haverty conceded to= move forward with it, a stipulation could be added that the owner would be fully responsible for the maintenance and upkeep of that portion. Mr. Viger noted that the owner was responsible for access off the Class V into the driveway regardless of whet= her it was paved or not. He didn'= t see that it made a difference for the whole thing to be paved.

Release indicate that the Selectmen have given Mr. Roger Montbleau permissi=

to pave up to 100ft. of the Class VI road to connect it to his driveway.
Mr. Lynde questioned how = the paving would impact the manner in which the Highway Department plowed the area. Mr. Gendron said he had= spent time in the area because of a subdivision that was being done and was famil= iar with the road section being discussed.&nbs= p; He said he didn’t know how the Highway Department handled plow= ing, but knew there was a cleared area that provided ample snow storage. He reiterated that the owner would= be responsible for that section to be cleared out. Mr. Lynde confirmed that Mr. Gendr= on's client would take responsibility for the section beyond where the Highway Department presently plowed. = Mr. Gendron answered yes; his client would need to keep that section of road op= en.
Mr. Lynde confirmed what = the motion was stating and questioned if the Selectmen were approving the issua= nce of a Building Permit. Mr. Gay= dos said the Selectmen were approving the ability for the owner to build off a Class VI Town road. Mr. McDev= itt said the Selectmen weren't giving the owner the permit, but the owner could= n't get one unless the Selectmen approve the request. Mr. Lynde clarified that the Selec= tmen were authorizing the Planning Department to issue a permit to build. He wanted to know if the pav= ing of the road came into that approval. Mr. Gleason said the agreement that the owner would execute would have a provis= ion contained within it that indicated the owner had the authority to pave the road. Mr. Lynde asked if the Selectmen were approving the paving, or if the owner would have to come back with the plans for paving the road. Mr. McDevitt said he didn't need to see the plans again. Mr. Gleason believed the motion wa= s good with the wording to grant the owner the authority to pave the road, since it was a Town road. He said reco= gnizing that the owner assumed full responsibility for its maintenance and upkeep forever. Mr. Lynde didn't hav= e a problem with the motion. He commented that there wasn't a stipulation on how the paving should be done = or to what standard. It would be= the owner's issue if there was a problem with the pavement.
Mr. Haverty questioned if= the Planning Board had made a recommendation.&= nbsp; Mr. McDevitt answered yes; it was fine with the Planning Board. They= did not object to the proposal. <= /p>

Board Approintments/Interviews:
Zoning Board of Adjustment
(1 Alternate and 1 Regular -

Christopher LaFrance (Alternate) – Mr. LaFrance came forw= ard to discuss his application for re-appointment to the Zoning Board. He had served on the Board for the= past three years and wanted the opportunity to continue. Mr. Lynde asked Mr. LaFrance if he= was familiar with the criteria for granting a variance and questioned if he app= lied them when making a decision. = Mr. LaFrance was aware of the criteria and stated he always applied them when making a decision. He said the Board ensured the applicants followed those criteria in each case. Mr. Gleason asked if Mr. LaFrance anticipated applying for a full-time appointment in the future. Mr. LaFrance answered yes; but at = this time didn't feel quite ready yet. He liked the learning experience and said possibly after this term w= ould be ready for that position. M= r. Gleason was happy to see a younger person involved with the Zoning Board and grateful for his volunteerism.

Forestry Committee (1
Position – 3 years)
Gayle Plouffe – Ms. Plouffe came forward to discuss her a= pplication for reappointment to the Forestry Committee. She had been a member of the Fores= try Committee since 1980. She dis= cussed her role and how her experience benefited the board. Mr. Haverty felt Ms. Plouffe's experience and application spoke volumes; he had no questions and was appreciative for her service over the years. Mr. Gleason further commended Ms. Plouffe for the work she had done.

Mr. Haverty asked if a mo= tion would be accepted the re-appoint Mr. O'Sullivan to the Board of Adjustment. Mr. Gleason belie= ved the Selectmen typically had applicants come in before the Board. Mr. Haverty said when there were no contested seats on appointed boards, the Selectmen(in the past) had made appointments. Mr. Lynde said = he liked speaking to applicants especially on the Zoning and Planning Boards.<= span style=3D'mso-spacerun:yes'> Mr. Gleason asked if Mr. O'Sulliva= n had advised the Board that he would not be present. Mr. Gaydos said a person wouldn't = have been put on the agenda if they hadn't been spoken to. Mr. Gleason asked if the Selectmen typically made appointments without a person presenting themselves to the Board. Mr. Gaydos believed pa= st history was that a person wasn't appointed unless they had a long track record. Mr. Haverty noted tha= t Mr. O'Sullivan had a long track record. Mr. McDevitt said new candidates usually came before the Board, but = that wasn't the case if someone had been around for a long time. There was further discussion as to whether the Selectmen would make the appointment of Mr. O'Sullivan. Mr. Lynde said he wanted to interv= iew people and couldn't recall making an appointment without meeting with an applicant.

OTHER BUSINESS
Fire Station Review
Mr. Gleason stated he did= n't expect a resolution, but wanted to start the dialog on the fire station so = the Selectmen might have the opportunity to direct Mr. Gaydos, or others, with = some course of action. He commente= d that the Selectmen had never discussed having a Special Election.
Mr. Haverty clarified tha= t the Selectmen had spoke of a Special Election being an option, but had not contemplated having that Special Election or pursued it.
Mr. McDevitt said the pub= lic should want to hear how the Selectmen are thinking on items. To have them throw ideas 'on the t= able' to discuss. He said when peop= le in the public spread lies it puts a damper on honest, open, give and take discussion. He stated the Sel= ectmen should have a discussion where all the ideas come out on the table and tell= the public that they may hear some things that are ridiculous.
Mr. Lynde said there were= some people that felt the Selectmen should trade off one safety solution for ano= ther safety solution. He said the round-about was a solution to the center of Town where people had been inju= red because of the way the traffic was set up.= It was dangerous and would grow more dangerous as time went on and traffic increased. The state = had done an extensive study where the public was welcome to come in and participate. Those involved w= ere educated on the process and in the end realized that the round-about was a long-term solution for the Town and was a good deal because it wasn't going= to cost nearly a cent because federal funds were 'earmarked'. Mr. Lynde stated that the fire sta= tion was another potential safety issue because in its current location once the round-about went in, the front doors would not be able to be used because o= f a one foot drop between the doors and the roadway. Vehicles will not be able to exit = out of the building. In both instanc= es, they were public safety issues. Mr. Lynde said eventually the Town would build a new fire station and the round-abouts would go in.
Mr. Viger said he would l=
ike to
continue to separate the round-about and fire station projects. The round-about would come regardl=
ess of
what would come with any vote for the fire station. He would like to address the fire
station issues knowing that the round-about was coming and create a time li=
ne and
a flow chart as to when the projects for the round-about would start and wh=
en
the front doors of the fire station would be closed. And establish what was to be done =
from
then and give alternatives. H=
e said
there may be enough time to put the fire station on the ballot again. If not, they would need to determi=
ne
what to do to make the existing fire station work with the round-abouts.
Mr. Haverty said they had= tried for a new fire station for many years and it failed. He said they could try to separate= the two issues, but the fact was the round-abouts were coming which would shut = the front of the fire station and impact service levels. He believed they needed to address= the service level concerns and mitigate those risks. He said absent of the round-about = there were several reasons why a new fire station should be built, but was not considering any of those as criteria. He stated the Town would have a signi= ficant decrease in service levels when the front of the building was shut off. He wanted to figure out how to sol= ve that situation.
Mr. Gleason didn't want t=
o get
into a discussion about the round-about; the issue was the fire station.
Mr. Gleason stated he was= looking for direction. Mr. McDevitt suggested setting aside time where they do some thinking 'out of the box' to determine how the Town could deliver good response time. He noted that the vast majority of people support the fire station.
The Selectmen discussed h= ow they would proceed. The state info= rmed that they would go out to bid in early 2012 and anticipated making an award= in May 2012 (to a contractor) at which time they will turn on FairPoint. FairPoint has a man hole in the mi= ddle of the intersection that housed most of their electronics. FairPoint would then go into the m= an hole and start relocating those electronics and making the modifications necessary to accommodate. At that time the Department of Transportation sus= pected they would have to close the front doors of the fire station to allow Fair Point to proceed. It was the state's impression that FairPoint would take approximately a year to comple= te that task. The state indicate= d they felt in total it would be a two year project that would start with the intersection in front of the municipal building to allow time for a fire station to happen. Per the st= ate, this scenario is the worst case situation.=
There was a consensus of = the Board to have a separate meeting/brain-storming session on Tuesday, May 3, = 2011 beginning at 6pm. Members of = the Budget Committee, Fire Chief and other Town employees offering information = will be invited to attend. The pub= lic was invited to attend the meeting and observe; the Board will not entertain discussion from the public. &nb= sp; It was suggested to put the fire station back on the ballot next Mar= ch and at the same time include any alternative in the budget. If the warrant article was to be approved, that amount (for the alternative) would be removed from the budget.
Young's Crossing – Change of Trucking Restriction
Mr. Gleason stated that l= etters were sent to abutters. One re= sponse was received indicating concern regarding the width of the road and whether= or not it would accommodate semi trucks. Mr. Gaydos said the third concern of the responder was that the road, which already showed wear/tear, would show even more with heavier trucks accessing the road. He told t= he Selectmen that he did some research and found the road to be 19ft. wide (measured from inside the white lines).&nb= sp; He said the widest truck that could pass on a New Hampshire road was 8ft.6in., without mirrors which added approximately 6in on each side, makin= g the total width 9ft.6in. Mr. Gayd= os said he viewed the road and reviewed the traffic and found it to get a fair amount of traffic throughout certain times of the day. There were a lot of two axle truck= s that traverse the road. He felt th= ere was merit in telling the neighborhood that the Town would watch the mainten= ance of the road. He believed if p= eople obey the speed limit the road would accommodate both trucks. He said if the road started to be = used as a major thoroughfare for larger trucks there was a possibility of conten= ding with a wear issue on the road.
Mr. Gleason asked the Sel= ectmen if they wanted to remove the restriction on Young's Crossing in light of the opposition from one residents and the rebuttal to it that the road was adeq= uate and the Town would assume maintenance should the trucking traffic cause a deterioration. Mr. Lynde beli= eved it was concern, not opposition.
The Selectmen appreciated receiving the resident's response. The trade off was that someone could be severely injured at the other intersection if the Town continued to force trucks over three axles down the other direction.
Mr. McDevitt made a motio= n to remove the restriction on Young's Crossing Road; the prohibition against tr= ucks over three axles using Young’s Crossing. Mr. Haverty asked if the motion in= cluded restricting that same access to the stretch further down. Mr. McDevitt answered no; he didn'= t feel that it had been given sufficient study.&n= bsp; The hope was that by allowing three axle trucks that some of the tra= ffic that would otherwise go up to that intersection at Ledge Road would otherwi= se use Young's Crossing. Mr. Gle= ason noted that the Highway Safety Committee was still reviewing options for the Ledge Road intersection. Mr. Haverty asked that the Highway Safety Committee review Young's Crossing to ensure all the appropriate signage for speed limits were in place.

Awarding Highway Crack Sealing and Paving Bids
Mr. Gleason stated that t= he agenda item only addressed the awarding of the bids, it did not guarantee a= ny repaving of any roads.

Limits of Municipal Liability Agreements Review & Possible V=
ote
Mr. Gaydos said they want= ed to create a Limits of Municipal Liability Agreement template; there are three possible uses, Municipal Responsibility and Liability Agreement for somethi= ng located on a Class VI road and an agreement that allows for a private road. The template was create= d by Planning Director Jeff Gowan and reviewed by Town Counsel.
The Selectmen didn't have
complete copies of the agreement. The Selectmen deferred the discussion.
Senator Jeanne Shaheen Visit Update
Mr. Gaydos discussed a re= cent meeting with Senator Shaheen and various Town and School officials. The discussion covered topic= s such as flooding issues, round-about process, first time offender programs, scho= ol funding, new fire station plan, continued funding for firefighter training programs, Willow Street Bridge project and holding taxes down.
Mr. McDevitt noted that S= enator Shaheen spent time at the fire station with the Fire Chief after the meeting.
Mr. Gaydos said the Town = would offer the Senator some space and encouraged them to schedule time to meet w= ith residents to discuss concerns.
March 2011 Revenue and Expense Review
The Selectmen were provid= ed with and reviewed a revenue and expense report containing information through the end of March.

Mr. Gaydos reviewed the a= ctions items.
Mr. Haverty and Mr. Viger= had no reports.
Mr. Lynde will provide information to the Selectmen on the Energy Committee mission statement. He said he reviewed the vendor list for 2009/2010 for anything over $10,000. The intent was to determine which items they should be involved in a= nd which should be put out to bid. Mr. Gleason said Mr. Gaydos could be asked to define the basis for some of the items.
Mr. McDevitt provided a r= eminder for the retirement party of Senior Center Director Sue Hovling that would be held May 1, 2011 at the Senior Center between 1pm-4pm. Tickets are $5 and can be purchase= d at the Senior Center office.
Mr. Gleason provided a br= ief report regarding the first Budget Committee meeting. He saw communication from Susan Sn= ide in the Assessing Department, who will be taking the initiative to conduct a regional meeting regarding assessment values. He commended Ms. Snide for her ini= tiative and endorsed the meeting.
