Police Chief Joseph Roark – Police Officers’ Special Recognition

Police Chief Joseph Roark= came forward and thanked the Selectmen for allowing him to formally recognize his employees. He wanted it clear= that a lot of Officers were being recognized, but there were other employees wit= hin the Department that were equally outstanding. He is proud of the Police Departme= nt and believed them to be second to none in the State. The following Officers were recogn= ized and given the following awards:

Chief Roark introduced Ce= lia Lingley the Department’s new Technical Administrator Manager.

The Selectmen expressed t= heir gratitude and appreciation for all that the Police Department brought to the Town. The Town was lucky to h= ave such dedicated and professional Officers.&= nbsp;

OTHER BUSINESS

Local Government Center Property Liability Trust – Insuran= ce Renewal

The intent was to have the Selectmen sign off on the three-year agreement. Mr. Gaydos stated there was no pen= alty for withdrawing; the agreement was an indication that the Town was committe= d to staying with the program. The purpose of the schedule was so the Town could receive special pricing. Mr. Gaydos summarized the types of insurances provided to the Town by the Local Government Center. The added benefit of training and resources was having a lower liability.&nb= sp;

Mr. McDevitt wanted to kn= ow if the obligations of the Town were being met. One example was to have a light du= ty policy. Mr. Gaydos stated tha= t the Town’s policy was if light duty was available it would be extended; t= his was done on a department by department basis dependant on the type of injury.

MOTION:

(Lynde/McDevit= t) To approve Addendums 4,5,6 & 7 of the different policies dealing with insurance for the Town through the Local Government Center and to authori= ze the Town Administrator to sign such.

Support Contract Review and Signing

Mr. Gaydos indicated that= the Support Staff contract (for a period of one year) had been approved at Town Meeting. This coming year sev= eral items would be revisited. Mr. Gaydos stated there weren’t many changes, but hoped to make a lot of progress with the unions in the upcoming years.

No motion was needed beca= use the contract was approved by the voters at the 2011 Town Meeting. The union had signed the contract.= All the Selectmen endorsed the con= tract (to expire March, 2012).

Municipal Construction Policy and Discussion and Approval

Mr. Gleason said the poli= cy had previously been brought to the Selectmen through a discussion with Planning Director Jeff Gowan. Mr. Gayd= os indicated that Mr. Gowan put the document together, which was then reviewed= by Legal and several others who reviewed and provided comment. The document presently before the Selectmen was the final version of the policy.

Mr. Gaydos explained that= they were more cognizant of things that had been overlooked in the past. Policies were being put in place so things weren’t overlooked again.&nbs= p; Mr. Gaydos stated that the policy would be for all Town buildings. They would like to include the Sch= ools because it was just as important for their buildings to have design review = and work inspected. He explained = the types of reviews/inspections/pre-construction meetings that would occur. The policy would ensure that jobs = were done correctly and projects had the necessary permits.

Mr. Gleason questioned if= the School Board had seen the policy and were in agreement with it. Mr. Gaydos said the School Board h= ad not yet seen the policy. He said = the school was subject to the authority of the Town’s inspectors. He explained they were trying to p= ut together a frame work to be able to have a meeting ahead of time to better understand projects. Mr. Glea= son felt it would be prudent to make sure the School Board had a copy of the po= licy and was aware of its existence. Mr. Gaydos said once the Selectmen approved the policy, it would be provided to= the School Board. They had been c= ontacted, but the final draft had not been given to them.

Mr. McDevitt stated that = the School Board was not subject to the policies of the Board of Selectmen; the Selectmen couldn’t pass a policy that would bind the School Board. Mr. Gaydos said the Town would pro= vide a forum for meetings to happen. He felt it was to their advantage to take part in that forum. He was hopeful that the School Boa= rd would want to adopt the policy and wanted to participate. Mr. McDevitt agreed with the spiri= t of it. Mr. Gleason agreed that t= he intent was good because it eliminated the opportunity for second guessing a= nd delays at the end of projects. He was a firm believer in everyone being on board in the beginning and understanding the requirements.

Mr. Haverty commented tha= t it was a good policy for the Town. H= e said if the School Board couldn’t be compelled to follow the policy he saw= no point in bringing it to them. He said they already knew they were held to the regulations. He saw no point in asking for their feedback because the Selectmen would probably not modify anything based on their feedback.

Mr. Lynde said the Select= men could adopt the policy and let the School Board know that it was a policy f= or any construction to the buildings and would be willing to offer the same services of review to the School Department, should they choose to use it.<= span style=3D'mso-spacerun:yes'> Mr. McDevitt said they could be encouraged to adopt the same policy. Mr. Gleason discussed a situation that occurred during the Senior Ce= nter project and hoped that the proposed policy would preclude the same instance from happening again. He said= they didn’t have to adopt it, but saw no harm in telling them that the Town had it and requesting that they consider it.

Mr. Haverty, being the li= aison to the School Board, said he would bring the policy to the School Board once t= he Selectmen approved the policy. He would let them do with it as they chose.&n= bsp; There were no objections.

Mr. McDevitt said if the = School Board adopted the policy, he would like abutter notification to be at their expense, not at the Town’s expense.

MOTION:

Energy Committee Discussion

Mr. Lynde said his goal w= as to establish a local Energy Committee for the purposes of exploring ways to approve how energy was used in the Town that they had control of and possib= ly save money or obtain money through grants.= He attended a conference in Pembroke - 3^rd Annual Energy Solutions Conference. He said= there were people from various towns in New Hampshire that had done different pro= jects and was really impressed with what they had done. He outlined the types of projects = that had been done and presentations that were given. Mr. Lynde said there were a number= of opportunities for the Town to improve how they used energy. He was interested in forming a com= mittee to review facilities and how the Town could save money. He said he would put more substanc= e to what he explained to the Selectmen and would like to get the word out that a committee was forming and the authority to appoint members.

Mr. Gleason asked how many members would be on the committee. Mr. Lynde felt there should be at least five members. It was his intention to put togeth= er a mission statement and a schedule. There was no objection to Mr. Lynde forming an energy committee. Mr. Lynde would compose a mission statement and encourage people to joint the committee.

Historic Building

Mr. Gaydos said every yea= r they updated the values of all the insurance coverage for all the buildings, whi= ch included the contents of the buildings.&nb= sp; He contacted the Historical Society and wanted to know if they would coordinate efforts. He was gi= ven a copy of the insurance document for the Historical Society building (former = Town Library). This began the thou= ght process of what documents the Historical Society had and if the Town should protect/insure them. The building’s lease (commencing July 1, 2003 and expiring April 30, 2053) was then reviewed. Mr. Gaydos reviewed a portion of the language contained in the building lease. He said the Town should have a key= to access the building.

Mr. Gleason asked if the = Town was satisfying the conditions of the lease relative to the maintenance and upke= ep of the exterior of the building. Mr. Gaydos believed the Town was working with the Historical Society= ; as things were found to be not in compliance they were being addressed. He noted some of the Town’s responsibilities and how they ensured they would keep up with them. Mr. Gleason asked how much had been expended on the facility in the past year.= Mr. Gaydos wasn’t prepared to answer. He noted that the roof, window and installation of the furnace had been done.= He will have an answer at the next meeting.

Mr. Viger questioned if M= r. Gaydos felt the tenant was in compliance with the lease. He noted he was reviewing all of t= he alarm systems in Town so they could be changed over to lower cost if there = was something of higher quality.

Mr. Gleason said the Hist= orical Society should be asked for a schedule of repairs they felt would be necess= ary in the next two years. Mr. Ga= ydos believed they had been concentrating on finishing the interior. He was unsure if an extensive list had been received and would follow up with them= . He wanted to let the Board be aware that the Town had to interact with the Historical Society; the Selectmen's comments would provide him with that direction.

Mr. Gleason asked that Mr= . Gaydos create a priority list for the Town buildings in terms of what had to be do= ne in the next two years. He said there was a limited amount of funds in= the Town repair budget.

Mr. Lynde said an invento= ry of the Historical Society building contents should be provided so the required insurance level could be determined. He also wanted to ensure that the Charter signed by King George was secure. He said it was the Town's understanding, at the time the lease was signed, that the building would be= come a show place for artifacts and open to the public. He was disappointed that it was still not available for public viewing after nine years. = Mr. Lynde stated that the Town should have a full picture regarding the repairs. He commented that a lot of money was being paid for electric= al work that was not going out to bid. He wanted to see the work go out = to bid.

It was Mr. McDevitt’= ;s belief that a vast majority of items within the building were private prope= rty or belong to the nonprofit organization of the Pelham Historic Society.&nbs= p; He didn't believe that a nonprofit organization would be required to provide the Town with a list of their possessions: they would be required to list t= he Town’s possessions. Mr.= Lynde said anything that was Town property should be protected. Mr. McDevitt wanted it clear that = there was no connection between the Historic District Commission and the Historic= al Society; they were totally separate things.

Mr. Gleason reviewed acti= on items that were being requested in connection with the Historical Building. He asked if the Fire Department conducted safety checks within the building. Mr. Gaydos answered no. He believed the Town needed to est= ablish a policy with the Historical Society that the landlord had a right to give notice and perform certain inspections and have access. Mr. Lynde said the Town had access according to the lease agreement. Mr. Gleason said it was a Town building and the Town should have a key. Mr. Lynde questioned whe= re the key would be kept. Mr. Gaydos= said there would be a lock box for emergency use.

Historic District Commission Update

Mr. McDevitt said a quest= ion had come up a few weeks ago by a resident who wanted to be appointed to the Historic District Commission. After conducting research, it was found that the Town had a Historic District Commission; as a land-use board if new members aren’t appointed after= the expiration of their term, those members stayed on. Mr. McDevitt provided a brief summ= ary of the Commission’s history. The Planning Director Jeff Gowan believed he should be considered in the decisi= on whether the board should be restarted or not.

Mr. Lynde confirmed that = there was a Historic District Commission, but there were no Historic Districts. Mr. McDevitt answered yes. He said the Commission’s pro= posal failed at the Special Town Meeting in December, 1974. He noted that because the Commissi= on was a land use board, only Town Meeting could do away with it. There was no record of Town Meeting doing away with the Historic District Commission.

Mr. Gleason recalled correspondence with Mr. Gowan who indicated that he wanted to delay any dec= ision pending his further evaluation and recommendation. He said the Selectmen would wait f= or input from Mr. Gowan.

Committee Openings: Planning Board Subcommittee and Planning Board Alternates=

Mr. Gaydos announced the = open positions for Planning Board Subcommittees and Planning Board Alternates. Those interested should contact the Selectmen’s office or fill out a volunteer form located on the internet.

Board of Health Discussion – Delegation of Article K Waive= rs

Mr. Gaydos stated if the = Board would like to delegate decisions relating to Section 295-1 (Article K) to t= he Deputy Health Officer Paul Zarnowski they were able to do so. He read a portion of the regulation aloud that gave the Selectmen that authority and the process by which they = could do so. The Board of Health wo= uld still be involved if someone were to appeal the Deputy Health Officer’= ;s decision.

Mr. Gleason said the Sele= ctmen had previously discussed the topic and felt it may be a desirable path beca= use of the amount of time spent on Article K’s and the expertise lying wi= th Mr. Zarnowski.

Mr. Viger saw a value in = having a separate body review Article K’s other than just the Health Inspector. He believed there = was some conversation and feedback that was accomplished at every meeting.

Mr. Lynde noted there wer= e a couple instances where they were glad they were watching it. He was reluctant to give up = the authority to review. He comme= nted that Mr. Zarnowski did a great job, however he wanted to make sure that peo= ple didn’t try to install a system on a lot that really shouldn’t be under consideration.

Mr. McDevitt supported the proposed delegation, but saw some drawbacks. He said there were times he review= ed the plans and couldn’t figure them out.&= nbsp; He questioned what part of the regulations the waste disposal portion was contained in and who had originally adopted them. Mr. Gaydos said Town Counsel’= ;s opinion came after reviewing the Ordinance with the Planning Director. Mr. Lynde stated that Article K was adopted by the Selectmen, as the Board of Health. Mr. McDevitt commented that he cou= ld only recall one application, in recent memory, that had been turned down. He said he was always looking to M= r. Zarnowski for his opinion.

Mr. Haverty couldn’= t recall turning down any more than one application in the last five years. He believed this was due to Mr. Zarnowski’s abilities to take care of applications prior to them comi= ng before the Board. Mr. Haverty= said he didn’t know the first thing about Article K’s and relied upon Mr. Zarnowski’s expertise. He was happy with Mr. Zarnowski doing the job until such time someone wanted to appeal a decision, or Mr. Zarnowski went elsewhere; anyone else would need = to earn the Board’s trust.

Mr. Lynde suggested writi= ng language with a restriction to replacement systems and not including conversions of houses etc.

Mr. Gleason said he also = relied on Mr. Zarnowski to answer certain questions. He agreed with Mr. Lynde about delegating the mundane items, but having unique cases come before the Board. He questioned if the responsibility could be segregated. Mr. McDevitt reviewed Legal’s opinion that stated the Health Officers (Selectmen) could grant such authority as they saw fit. If desired, they could delegate Mr. Zarnowski the authority to only approve replacement systems. The Selectmen agreed to the suggestion. Mr. Gaydos said he would obtain wording for a limited scope and bring it back to the Selectmen= for review and placement in the Ordinance.&nbs= p; The language would also be run by Mr. Zarnowski.

Flooding Update

Mr. McDevitt informed tha= t a meeting was held last week and attended by approximately thirty people who included representatives from the Town and state and a number of residents. He said they were = still in the fact finding stage and came up with the next steps to follow. One item was FEMA flood mitigation= that could be done for individual property owners. A meeting would be put together for residents directly affected who might be eligible for FEMA mitigation. The representative from the City of Lowell with the representative from the Army Corps of Engineers came up wit= h a possible way for funding through money being spent on the Merrimack River t= hat may benefit a Beaver Brook study. There were questions raised by the FEMA representative regarding the accuracy of local flooding maps and the possibility they could be reviewed because of local conditions which ch= ange them. Another item was a comm= ent by the gentleman from Congressman Bass’ office who felt if the folks from Lowell and Dracut had flooding issues along Beaver Brook, possibly Congress= man Bass and Congressman Tsongas could speak.&= nbsp; There may be more weight for federal help if there were interstate solutions. Mr. McDevitt state= d it was pointed out by all the Federal representatives that this was probably n= ot the time to look for federal funds. He said it was clear that what was going on was not just a local iss= ue, but was a regional issue. Alm= ost everyone along the brook had flooding issues from one degree to another. Mr. McDevitt hoped that the expert= ise of Mr. John Lavigne from the H.L. Turner Group would continue through the process.

Mr. Lynde said he previou= sly raised the question if a simple calculation could be done to see if the vol= ume of the water flowing under the bridge with the current design was different from the prior design. Mr. Mc= Devitt said he didn’t ask the question to the Department of Transportation (‘DOT’) representative. The representative was a substitute and knew nothing about the Main Street Bridge. It was noted t= hat the DOT didn’t have a file for the bridge prior to the installation of the culvert.

Mr. Gaydos noted one poin= t made by Mr. Lavigne was the elevation difference and how the slope changed dramatically when coming in from the Londonderry area to the Abbott Bridge = (Old Bridge Street North) and Willow Street.&nb= sp; He said the glimmer of hope for federal money was that the Army Corp= s of Engineers already had funding to do work on the Merrimack watershed area, on which Beaver Brook was part of. There was already an open account that got continuous funding, which= by taking a regional approach may cause some funding to go in there for the expansion of the project.

Mr. McDevitt said they we= re still defining what money might be spent on, if it were to be received.

Mr. Gleason questioned if= there were plans for subsequent meetings. Mr. McDevitt answered yes, but a date had not yet been specified bec= ause there was additional information that needed to be gathered. He said the Planning Director was = going to pursue a FEMA mitigation, meeting. He said there was a risk in holding meetings that didn’t have substance. Mr. Gleason asked = if there was any other action being taken in Town. Mr. Gaydos believed the Planning D= irector was taking action. He said on= ce there was more input from the other towns in Massachusetts, there was discussion about having a game plan to get regional support from state representatives so letters could be sent to Washington to try and get addit= ional funding. Mr. Gleason wanted to know if Steve Keach of Keach-Nordstrom (Planning Board’s engineering review firm) would be involved. Mr. Gaydos said he would see him on Thursday and would get involved.

Mr. Mike Sherman (residen= t of Old Bridge Street), came forward and told the Selectmen that another item which came up in the meeting was that some of the surrounding communities, as wel= l as the state of Maine didn’t allow any building within the flood plain.<= span style=3D'mso-spacerun:yes'> He said this was the type of chang= e that the residents would like to see considered in Pelham. He explained when the flood plain = is filled in, water had no place to go except to their homes.

Mr. McDevitt noted that t= he Planning Board proposes zoning changes; it would be originated, discussed, drafted and approved there. <= /p>

Action Items

The Selectmen reviewed th= e action items.

Mr. Gaydos explained that= a sidewalk was supposed to run from the intersection of Windham Road along the northern side of Nashua Road up to the Senior Center. Because of certain setback conditi= ons the sidewalk was moved to the opposite side of Nashua Road. The remaining question was if the = Town wanted to continue to have the sidewalk or have it eliminated from the proj= ect. Currently the cost was included wi= th the project. There was further discussion regarding the sidewalk and the reason it was included to begin with. Moving the sidewalk acr= oss the street seemed to defeat the original purpose. To be discussed at the next Depart= ment of Transportation meeting to see what the cost savings of taking the sidewa= lk out would be.

Mr. Gaydos discussed items reviewed by the Highway Safety Committee (‘HSC’). He said Planning Director Jeff Gow= an will take the request of having a flashing yellow beacon suspended overhead= at the approach of Old Gage Hill Road with the Department of Transportation. The HSC strongly urged the Selectm= en to approve the removal of the No Trucking signs/trucking limitation from Young’s Crossing immediately while they work to secure funding for the installation of electronic speed signs and flashing yellow light.

Mr. Haverty believed the = Board had agreed to hold action until getting feedback from people in the area and informing them of the actions. Mr. Lynde believed he previously proposed delaying decision to allow anyone watching the program to come back with comment. He said the Selectmen could post an agenda item for a vote. Mr. H= averty said he would like to see something more proactive, such as the Town sending notification to residents. Mr. McDevitt agreed. There was no objection. Notification would be sent to resi= dents regarding the proposed change and the reasons for such.

TOWN ADMINISTRATOR / SELECTMEN’S REPORTS

Mr. McDevitt reported tha= t the New Hampshire Preservation Alliance celebrated it’s 25^th anniversary and recognized twenty-five projects throughout the state that w= ere determined to be preservation milestones.&= nbsp; The first project was the Abbott Bridge restoration with a picture of Ann Hargreaves. Mr. McDevitt = noted that the Abbott Bridge was the only surviving double stone arch bridge in t= he state.

Mr. Lynde stated that he = attended the Municipal Advocacy Committee meeting in Concord. He summarized the topics that were discussed. He noted that the Forestry Committee met with a representative from U.S. Fish and Wildlife. They were reviewing the Gumpas Pond wildlife area to possibly make preserved area to entice the habitat of increased plants and wildlife. Approval will be needed from the Town to enter into an agreement with U.S. Fish and Wildlife for this purpose.&n= bsp; Mr. McDevitt said concerns were mentioned to him if the Feds came in they may impose restrictions/regulations that the Town may find odious. Mr. Gaydos stated that the Town= 217;s Forester was very involved in the program.= One of the advantages was during this phase, the Federal government would not have those (permanent) restrictions; this was one of the incentives.

Mr. Haverty commented tha= t during his full-time job he had the opportunity to attend a meeting with the Massachusetts DOT in regard to a project they would be doing on Route 93 between New Hampshire and Boston. Most work would be done through the weekend, but would involve shutt= ing down an entire side of the highway and moving traffic to the other side. March 22, = 2011

· ~~Review signs on Willow Street (Don Foss) – request from Open Forum (Mr. Gaydos to follow up with Don Foss~~) (resolved 4/12/11);

· ~~Selectmen to inform Mr. Gleason of intere= st to be representative to Forestry Committee~~ (resolved 3/29/11);

· Mr. Gowan to advise Selectmen whether the CIP will be instituted; ~~Mr. McDevitt will contact Planning Director Gowan re: Planning Board’s intentions for (reforming)~~ CIP (Planning Board to make final decision- Selectmen resolved 4/12/11- left open for further resolution by Mr. Gowan);

· Speak with Garden Club re: decorating round-about and possible lighting in future (Mr. McDevitt);

· ~~Mr. Gaydos will follow up with state re: funding for round-about~~ (resolved 3/29/11);

· Add agenda item to discuss/analyze fire stat= ion (4/12/11 - Mr. Gaydos spoke with Trident regarding punch list, time line and associated costs);

· Copy of updated Operating Budget to be provi= ded to Budget Committee showing how each department was effected (Finance Director); (4/12/11 – spread sheet completed will be distributed);

· Mr. Gaydos to ask Police Chief to provide information/’game plan’ regarding School Resource Officer (4/12= /11 – SRO process started in May and to be hired in July);

· Planning Board to make recommendation to Selectmen regarding Article #14 (portion of Mulberry Lane, portion of Sheph= ard Road and all of Lannan Drive);

· Mr. Gaydos to put timeline together for Cast= le Hill Road;

April 12, 2011

· Mr. Gaydos to determine the amount spent on = the Historical Building during the past year;

· Mr. Gaydos to ascertain Town property items = in the Historical Building for insurance purposes;

· Historical Society to provide a list of work they anticipated would need to be done and the time frame for that work;

· Mr. Gaydos to inform Selectmen what work the Town would anticipate doing in the Historical Building (i.e. alarm system);=

· Mr. Gaydos to draft limited scope delegation language for Article K Ordinance to be reviewed;

· Letter to be drafted and sent to residents regarding the removal of trucking restrictions on Young’s Crossing – to be posted as an agenda item.
