PUBLIC HEARING: Re= garding Proposed Amendments to the Town Parking Ordinance

The Selectmen reviewed the proposed amendments to the Town Parking Ordinance. The fees will be reviewed/addresse= d at a later date for consistency. I= t was noted that Stephanie Drive= was added to the streets included in the ordinance.

PUBLIC INPUT

Mr. Jaimision Smith, 13 Quail Run Lane questioned what the resolution would be and when it would go into effect. Mr. Viger said the Selectmen were reviewing the proposed ordinance at this time; it would go into effect as s= oon as they approved/signed off on it. Mr. Smith wanted to know if there would be a ban on parking or fines. Mr. Viger explained th= at the ordinance pertained to the entire Town; Quail Run Lane had been included. Mr. Gleason read aloud the paragra= ph within the Ordinance that covered Quail Run Lane.&nbs= p; There will be a restriction of parking on the street between the hou= rs of 7am-3pm Monday = thru Friday. It was suggested by P= olice Lieutenant Fisher to add the words ‘while school is in session’= .

Mr. Michael Martin, 32 Quail Run Lane asked what prevented his street from having the same ordinance as Stephanie Drive. It was explained that there had be= en an oversight in the original ordinance; signs were installed, but the street w= as not listed in the ordinance. = The proposed Ordinance included Stephanie Drive.

There was further discuss= ion regarding the proposed language and the suggestion made by Lieutenant Fishe= r to add ‘while school is in session’. The Selectmen decided to add = the words ‘while school is in session’. Under Section 3, the second refere= nce to ‘no persons…’ will be deleted in the subparagraphs.

MOTION:

It was noted that the ame= nded Town Parking Ordinance was effective upon passage.

OPEN FORUM

Mr. Leo Thibeault came fo= rward to commend the Town’s Police and Fire Departments. He discussed a recent medical emer= gency that required admittance into the hospital and his interaction with the Town’s emergency staff. He discussed the fire station and the Town’s need for a new station.

Mr. Lynde arrived.

APPOINTMENTS

The John H. Hargreaves Memorial VFW Post #10722, Mark McCabe Vet= eran Affairs

Past Commander Kenneth St= ubert addressed the Board. He said Sergeant Daniel Gionet was killed in action in Iraq. It was the VFW’s understandi= ng that the Board of Selectmen had endorsed a plan to provide a memorial for S= gt. Gionet. It was also their und= erstanding that the memorial itself, the location and the time line had not been decided. Mr. Stubert said it = was the desire of the VFW to have a decision made regarding a memorial so Mr. Gionet’s family will have closure.&n= bsp;

Mr. Lynde said he had app= roached the subject and suggested that a fitting approach would be to name one of t= he two soccer fields at Raymond Park in Sgt. Gionet’s memory. He said they wanted to combine it = with a second one in memory of a Pelham soccer player who was killed on Marsh Road.= Mr. Lynde asked the Board if they = would be receptive to having someone step forward to move the process along. There was no objection. Mr. McDevitt said he spoke with Mr= . Mark McCabe for suggestions, one being the naming of one of the round-abouts (in= the Town center) and another suggestion was to have an inscribed bench on the village green. He said he wou= ld like feedback from the Veterans as to which would be appropriate.

Mr. Stubert discussed the possibility of setting up a veteran’s affairs group/committee to work with the Town regarding activities so a single point of contact could be created. With regard to Sgt. Gionet, he said the VFW would be happy to have a representative work with t= he Selectmen directly.

Charlie Mooskian, Departm= ent Chaplin for the State of New Hampshir= e came forward to expand on the conversation. He said the VFW had discussed the = veteran’s affairs group and wanted to know if the Selectmen would like to form someth= ing similar to the Senior’s Council on Aging. He said the point was to work as a= team with the Town. Mr. Gleason commented that the Town had no financial responsibility to the Council on Aging; they worked on their own with the Senior Center and were an autonomous group. Mr. Gaydos said he had some ideas to achieve what they wanted. Mr. Viger suggested getting togeth= er to work. Mr. Stubert said they w= ere willing to work in whatever direction would be best to pull the whole thing together.

Mr. Haverty asked if some= thing similar had been implemented in other communities in the area. He agreed with the concept, but was stuck on how to get it going. Mr. Mooskian said it was done in other towns and at the state level. Mr. Stubert said they could do add= itional research and provide the Selectmen with possible models.

Mr. McDevitt cautioned th= at if the Selectmen formed/appointed a committee, it would then be a public commi= ttee to the extent that the meetings would need to be posted and held publicly, = and would be subject to the right to know laws. He said if the VFW formed a commit= tee and asked for a Selectmen Representative, it would not be considered a publ= ic committee. Mr. Mooskian said = they didn’t mind having the meetings in public. Mr. Viger said there was value in = having such a committee and suggested they keep in contact to discuss ideas.

Mr. Mooskian commented th= at in speaking to the Gionet family, they would love to have a ball field named a= fter Daniel. He said it was due to health of Daniel’s grandfather that the family would like a memorial = to take place. He said the Veter= ans (and the Gionet family) felt it would be an honor to have one of the round-abouts or a monument named. He said if both could happen it would be an honor. Mr. McDevitt said if a ball field = was available, they should move forward with it. Mr. Viger commented that there may= be deed restrictions. Mr. McDevi= tt said there was no requirement on the deeds (at Raymond Park) regarding nami= ng the soccer fields. He said at= the next meeting he would provide information on what the deeds specify and what Town Meeting said about them.

Mr. Haverty suggested put= ting a time line on the process. An = agenda item will be added for July 27, 2010 for a progress update. Mr. Gleason said he would like the veterans to identify the participants and come back with a conceptual idea = of what they envision the committee to be and do.

Mr. Lynde volunteered to = be the contact person for the veterans.

Article K Waiver - Map 28, Lot 7-208, 21 Sawmill Road – Owner(s) Richard and Louise Michaud c/o Ken Cooley

The Selectmen recessed th= eir meeting. Deputy Health Office= r Paul Zarnowski came forward to Chair the Board of Health. Mr. Zarnowski called the Board of = Health meeting to order. He then rev= iewed the requested waivers: 1) Section 295-16 – leach must be at least 100= ft. from very poorly drained soils – request is 75ft.; and 2) Section 295= -14 – leach bed shall be at least 4ft. to seasonal high water table at the center – request is 2.5ft.

Mr. Ken Cooley, represent= ing the owner, came forward to discuss the requests. The proposal was to move the failed leach from the current location in the rear, to the front left corner of the home. It was the best locatio= n for the field based on the setbacks from the wetland.

Mr. Zarnowski said they i= nitially reviewed to see if the system could be replaced ‘in kind’ and discovered that the existing system was too close to the water table. The existing system is approximate= ly 48ft. to the very poorly drained soils. The proposed design meets all the s= tate criteria for the Enviro Systems.

Mr. Gleason asked if the = gas line needed to be relocated. Mr. C= ooley said the line was to a propane tank which would be rerouted around the back side of the field. Mr. Gleason wanted to know if the current pump and tank would be maintained. Mr. Cooley said it would be replac= ed depending upon its condition. The leach field will be abandoned.

Mr. Lynde asked if a seco= nd tank would be added. Mr. Cooley sa= id if the original was in good enough condition, they may add a second tank; using the original tank as a pass through for the pump. If the existing tank wasn’t = in good condition they would have the pump directly into a new tank. Mr. Lynde summarized his understan= ding that there was an existing system that shouldn’t have passed to begin with and with the Article K the situation would be improved because of the constraints on the lot. Mr. Zarnowski reiterated that the proposal met all current state criteria. Mr. Lynde asked if the proposed sy= stem was a standard system. Mr. Zarnowski said it was an Enviro Septic by Presby. He went on to discuss the benefits= to the system. Mr. Lynde asked if there were any problems with the water line coming in from the street. Mr. Zarnowski answered no and disc= ussed what would be done to protect the water line.

Mr. Gleason confirmed tha= t the existing system was gravity fed into the leach field. Mr. Cooley answered yes. Mr. Gleason asked if the second ta= nk contained a pump to get to the leach field. Mr. Cooley answered yes.

MOTION:

(Lynde/Gleason= ) To grant a waiver to: 1) Article 295-16 for Map 25 Lot 7-208 –the requirement is for 100ft. from very poorly drained wetlands – the waiver is to allow it to be at least 75ft. from very poorly drained wetla= nds; and 2) Article 295-14 that says the bottom of a leach bed shall be at lea= st 4ft. to the seasonal high water table and to allow it to be 36inches.

The Selectmen reconvened = their meeting.

Senior Cente= r Voluntary Contribution Disburseme= nt of Funds - $6000 plus interest to date

Mr. Gleason said in the <= st1:PlaceName w:st=3D"on">Senior Center extension they found there was $6000+ in impact fees that had been accrued toward any future growth in the Senior Center. He said the intent was to pay for = the architectural fees for the expansion out of the money, but it had to be mov= ed to be able to.

Mr. Lynde asked if the mo= ney was in addition to the amount appropriated.&nb= sp; Mr. Gleason said $279,000 had been appropriated; these funds were im= pact fees. It would cover the architectural cost. Mr. Viger= said the problem he had was that a certain amount of money had been appropriated= for the Senior Center and now that money was foun= d they would be spending more than was initially approved by the voters. He wanted clarification as to why = the architectural drawings weren’t covered in the initial cost and what ‘extra’ they would get for the $6000. Mr. Gleason said it had been his understanding that impact fees were collected to help cover the cost of expansion or replacement of the Senior Center. He felt this ($6000) fell into that category and it was an appropriate use for the money. Mr. Viger said it wasn’t identified in the warrant article. <= /span>Mr. Gleason said he wasn’t aware that the funds existed until after the approval. It was brought to h= is attention by the Senior Center that impact = fees were collected and in checking with the Planning Department they found that there were funds.

Mr. Lynde said normally m= oney is appropriated and its indicated how much would be used for a project. He said the Town had used impact f= ees without Town approval to do architectural renderings, such as for the fire station.

Mr. McDevitt said it was = an interesting set of circumstances. He agreed that impact fees had been used for the fire station to com= e up with a plan to put in front of the voters.= He said at the same time, a plain reading of the warrant article wou= ld lead one to believe that the cost of the building was $279,000. He said it seemed that impact fees should lessen the cost to the taxpayers so the $139,000 in general taxation should really be $133,000. Mr. McDevitt asked what the overall cost for the project was expected to be.

Mr. Viger said money was = spent on drawings for the fire station, but it was in anticipation of lessening the amount that would go to the warrant article; it was a preliminary step.

Mr. Gaydos stated that im= pact fees were exempted from RSA:32; they don’t have to be appropriated, t= hey only have to be committed by the board that oversees it.

Mr. Lynde couldn’t = recall an instance where the Board didn’t have a prior discussion when spend= ing money for drawings etc. and approving such. He said in th= is case it was after the fact. M= r. Gleason said the money had not been committed. Mr. Lynde said the request was to = use the impact fees to pay for something that had already been done because the= re wasn’t enough money in the funds that were appropriated. Mr. Gleason said if the impact fees don’t offset the cost, the architectural fees will have to be absorbe= d in the $279,000. He said the dra= wings had to be done before they could proceed; if they hadn’t found the im= pact fee money it would have come out of the $279,000. He reiterated that it seemed to be= an appropriate use of the impact fees for the purpose in which they were intended.

Mr. Gaydos believed this = was a case of matching expenses and available funds. He said the Council on Aging had m= oney, the Town had money, there was money sitting in a fund that was previously appropriated and then there’s the $6000. He said the Board would have to fo= rmally vote to commit the money to some part of the project. Mr. Gleason said when they found o= ut there was $6000 in impact fees, they wanted to put it to good use. Mr. Lynde wanted to understand the process. He suggested hearing= what Mr. Gleason had to say about the project in general.

Mr. Viger said his proble= m was the procedure and questioned why the Board was just now finding out about t= he impact fees (after two years). Mr. Gaydos explained that impact fees are not appropriated. He said when the warrant article w= as being written there was considerable discussion about what the numbers had = to be to make it legal; the appropriation was for how much money would be raised. Impact fees are exemp= t and were not included.

Mr. Viger said he would e= ntertain a motion to spend the $6000 impact fee, plus interest to date. No one made the motion. Mr. Haverty supported Mr. Lynde= 217;s suggestion that the Selectmen hear what Mr. Gleason had to say about the project prior to making a decision.

Mr. Gleason discussed the= Senior Center. He said there were eleven bidders = for the project with the low bidder being $257,000 and all others were over $300,000. There was a meeting= with the low bidder, Trident and Roland Soucy; it was Trident’s recommenda= tion to speak with at least two or three of the bidders to determine why there w= as such a gap between the low bidder and the next bidders. It was previously believed that the project would come in lower than the cost.= They didn’t want to modify the specifications until trying to determine if there was something specific driving the cost up. There was a brief discussion regar= ding the situation and the costs. A comment was made that they may need to reduce the footprint of the building. The original design= was for a 1500SF building; the approved building was 3800SF. Mr. Lynde felt it would be prematu= re to take any action until there was further clarification. Mr. McDevitt said if there was goi= ng to be a bidders conference, the low bidder should be included. Mr. Gleason said the intent was to= ask the bidders to define their bids; they wanted to see a breakdown. It was not the intent to allow conversation regarding specification reduction; they were trying to determi= ne what was driving the costs up.

Mr. McDevitt said when it= was appropriate, he wanted to make a motion to spend the money because they incurred an expense. Mr. Vige= r said he would take a motion to spend $6000 out of the impact fees toward the Senior Center project. Mr. McDevitt made the motion; Mr. Gleason seconded the motion.&n= bsp; Mr. Lynde questioned why a motion was being made because invoices normally were in the manifest. Mr. McDevitt said it was because impact fees were being used. Mr. Gleason explained that the mon= ey would be ‘pooled’ together so all bills would go against one account having a total project cost that could be consolidated. He said the invoice had already be= en paid against the account.

Mr. McDevitt made a motio= n to take $6000 in impact fees and apply it to the Senior Center project. Mr. Lynde seconded t= he motion.

Mr. Gaydos said they woul= d be speaking for other contractors to get a feel for where they were with the project. A decision would the= n be made and recommendations formed. Mr. Gaydos believed it was Mr. Gleason’s intent to come back before the Board with a plan of action that would include the next steps.

Mr. Haverty said the Sele= ctmen had just voted to move an impact fee into the Senior Center project and questioned what the balance was for impact fees. Mr. Gaydos said the vote was for t= he $6000 plus interest to date; the remaining balance was zero. Mr. Haverty said impact fees could= only be used to address future growth. He asked if there was any objective criteria to show that the buildi= ng would address future growth. = Mr. Gaydos said it was technically not an impact fee, it was a voluntary contribution (the same thing as a gift).&n= bsp; Mr. Lynde asked if there was an impact fee schedule for the Senior Center. Mr. Gaydos said they didn’t because it was a voluntary contribution.&n= bsp; There is no impact fee mechanism set up for the Senior Center. Mr. McDevitt asked if the money wa= s a donation. Mr. Gaydos stated t= hat it was a voluntary contribution that was set up through the Planning Departmen= t as an attempt to address some local issues that the Planning Department felt w= ere important. He explained that = the money had come as part of an approval (by the Planning Board) for a develop= ment in the Sherburne Road area. Mr. McDevitt asked if t= hat was an exaction. Mr. Gaydos answered yes. He said because= they had no frame work to deal with the exaction or voluntary contributions, they agreed to use the same process for expending them as they would for impact fees.

Mr. McDevitt said the ear= lier motion was to spend impact fees, which there were none. He then made the following motion,= which was seconded by Mr. Haverty. = Mr. Gaydos said the wording used by the Planning Board was ‘voluntary contribution’; he didn’t know the difference between the two. Mr. McDevitt let the motion stand.= Mr. Lynde said he wouldn’t s= upport the motion because he didn’t like the terminology. He felt there should also be a ‘trail’ for the money and wanted to review the information. Mr. Gaydos said he would get the Planning Board minutes for the Board to review.

MOTION:

(McDevitt/Have= rty) To spend $6000 in exactions (exacted by the Planning Board), plus interest, for the purpose of offsetting costs associated with the Senior Center.

Fire Chief Midgley – Fire Department Budget Status

Fire Chief James Midgley = came forward to discuss the status of the fire department’s budget. He explained that there were some = issues coming up in the next few weeks that could potentially have an impact on the budget. There are two employe= es who will be out on disability. Ch= ief Midgley said the budget was currently okay, but cautioned that depending on which direction the workman’s compensation cases went it could get difficult and cut backs would need to be made. He said they had done a significant amount of cut backs last year in anticipation of having employees out. He noted that his average payroll = ran at approximately $22,000 per week; the last several weeks with the workmanR= 17;s compensation cases, training = and vacations they were running at approximately $28,700 - $29,200. He said the budget couldn’t sustain that type of impact for very long and felt it necessary to make the Board aware that all of the things were out of his control. They would do everything they coul= d to bring the budget in on track, but short of cutting services toward the end = of the year, Chief Midgley didn’t know how well it would work.

Mr. Viger told the Chief = that the Board appreciated bringing the information forward. He said he wouldn’t hold aga= inst the Chief personnel issues. He didn’t expect that services would be cut because of the budget being overexpended.

Mr. Gaydos wanted it clea= r that due to training and employees being out the coverage would be at time and a half. He said because it was a workman’s comp. issue a replacement couldn’t be hired.

Mr. Viger asked that the = Chief continue to update the Board as things progressed. He told the Chief to maintain the = level of service as he had been; they would figure things out as they went along.=

OTHER BUSINESS

Continued Discussion – Family Health Benefits Extension to Divorced Employee’s Spouse

Mr. Gaydos said the quest= ion was if the Town had a married employee with insurance coverage, who then became divorced, who should pay for insurance coverage, if there was a possibility= to extend that coverage to the employees ex-spouse. He explained that there was no pro= vision in the Town’s contracts for ex-spouses.

Mr. Viger asked what the = Town was obligated to do by law. Mr. G= aydos said it was nothing more than agreed to in the contract. He said the Town had to provide an= opportunity for someone who was on the insurance plan, who for whatever reason leaves t= he insurance plan, the opportunity to purchase it at its full price (Cobra) for thirty-six months.

Mr. McDevitt said the Town’s contract was with the employee, and to the degree that the per= son is married and has dependants it extends to those people, but felt once the employee was not married the agreement with them (in that regard) ended. He said the Town had the obligatio= n to cover the employee, but not to go further.= He said given the burdensome cost of employee healthcare on taxpayers the Town should do everything possible to minimize that cost. In his opinion, he didn’t wa= nt coverage to go past one day of the divorce because it wasn’t the taxpayers fault that someone got divorced and they shouldn’t have to = bear the additional cost. Mr. McDe= vitt confirmed that there was no additional cost to the taxpayers for Cobra; the Town didn’t contribute. Mr. Gaydos answered yes. He said = the complexity was an employee had the opportunity to purchase either a single = plan, a two-person plan or a family plan. Under the family plan, there was no additional cost (to the taxpayer= ) to adding the ex-spouse because the plan was already being purchased. Mr. Gaydos said the plan would sti= ll only go (be extended) for thirty-six months because that is the term. He said his recommendation was to = not have the taxpayer incur any additional costs because of whatever happens in= the unit.

Mr. Viger asked if the in= surance company cared if the Town put ex-spouses on the plan. Mr. Gaydos said when the situation arose, the Town asked what the insurance company allowed and the insurance company in turn wanted to know what the Town wanted. He noted that the Town had rules a= bout who would be covered, but they needed a policy to be consistent with all the unions because all the policies were silent on the issue.

There was a discussion ab= out the different situations of insurance coverage. Mr. McDevitt suggested that Counsel review the words carefully. Mr. Gaydos said he would be more than happy to seek Counsel’s opinion. Mr. Gleason believed= the policy should be kept simple; when a person gets a divorce, the coverage was adequate to protect the children. He felt by opening the coverage up another tier it would invite futu= re problems. Mr. Gaydos said the bottom line question was who would pay for the extended coverage; all the contracts were silent on the issue. He said he would try to make the language as succinct as possible and request Counsel’s opinion.

Discussion – Pelham Ice Garden/Community Spirit Group̵= 7;s Request for soda machine to be placed at Lyons Park

Mr. Lance Ouellette came = forward to discuss Pelham Ice Garden/Community Spirit Group’s request for a s= oda machine to be placed at L= yons Park. He said in January it was proposed= there was a site for a couple of soda machines.&= nbsp; They felt it would be a good opportunity to raise money and have it = go back to the community. They didn’t realize all the channels they had to go through and had receiv= ed approval from Pepsi and removed the old (Coca-Cola) vending machine. There were two machines on the sit= e that had been in use, but were now discontinued until the matter was settled.

Mr. Gleason asked who wou= ld be responsible for the general maintenance to the machines and any vandalism t= hat occurred. Mr. Ouellette said = Pepsi covered liability/vandalism to the machine under their contract. He said they would like to post si= gns indicating a phone number to call with any problems; the contact for the pu= blic would be Mr. Ouellette or Mr. Chris Mader.

There was a brief discuss= ion regarding the request. Mr. Ga= ydos asked who would fill the machine. Mr. Ouellette said he and Mr. Mader would fill the machine. Mr. Gaydos believed the vandalism occurred either when the machine wasn’t operating or when it was sold out. He noted there would be a donation/reimbursement for the electricity. Mr. Ouellette said he had made the= offer for his company to pay the Town up front for a full year of the estimated electricity costs. The estima= ted cost was $17 per month.

Mr. Lynde asked if there = was contract between Pepsi and Pelham Ice Garden. Mr. Ouellette said the contract was between Pepsi and A Handy Company because it had to go through a commercial= ized company.

There was a consensus of = the Board that Mr. Ouellette was all set and could fill the machine up. Mr. Ouellette questioned the billi= ng process. Mr. Gaydos said the = Town would send a bill.

Discussion – Job Description for Senior Center Director

The Selectmen reviewed th= e proposed job description for the Senior Center Director position. Mr. McDevitt suggested that the Co= uncil on Aging provide input. There= were slight amendments made to the requirements. Mr. Gaydos will make the changes a= nd forward a courtesy copy to the Council on Aging.

Review of Transfer Station/Recycling Center Updates

This was deferred.

2010 Monthly Town Budget Perform= ance Review

Mr. Gaydos reviewed the 2= 010 monthly Town budget performance. In summary all the departments looked like they were doing well. Mr. Gleason noted that under Cemet= ery, it listed there was perpetual care revenue, which had been eliminated in 2008.= He said any money collected should= go into the Cemetery General Maintenance Fund. Mr. Gaydos said he would find out = what it was.

Mr. Haverty said Library, Recreation and Transfer repair items looked high for this time of the year = and asked if there was a problem that should be watched, or it was typical. Mr. Gaydos said he would review the individual items; it depended if there were projects being run.

TOWN ADMINISTRATOR’S / SELECTMEN’S RE= PORTS

Mr. Gaydos said = he was meeting with several people regarding flooding issues. He found it interesting when meeti= ng with the state on Old Brid= ge Street North because of a comment indicating t= hat there were a series of culverts under Route 38. He had the Highway Department look= at the culverts and identified one that had been totally plugged by beavers. They would be locating the others = and said it might be the first step to a solution. Mr. Gaydos reported they were continuing with budgets; the Selectmen would start their review next week.<= span style=3D'mso-spacerun:yes'>

Mr. Haverty aske= d if there was any update regarding Shannon Circle. Mr. Gaydos said all the easement documents had been returned. He didn’t have a date regard= ing excavating. A post card will = be sent to the property owners indicating when the date is set.

Mr. McDevitt tha= nked the Police Department for the good job they did in moving traffic during the Independence Day Celebration held on July 3, 2010. =

Mr. Lynde report= ed that the Concerts on the Common had started.&nb= sp; They had a successful first concert. The next concert will be held July 7, 2010 beg= inning at 4:30.

Mr. Viger had no= report.
