The amendment to the minutes were as follows: page 3, Election of Officers, 2nd sentence – the word ‘officers’ was replaced with ‘members’; page 4, Pet Policy – the sentence reading ‘He said it was an important policy and he would recant himself from abstaining from a vote.’ was amended to read ‘He said it was an important policy and he would recant on his prior statement that he would abstain from further discussion or voting on the matter. ‘; the ending time and motion was 10:25pm= , Haverty/Lynde.

OPEN FORUM

Mr. Paul McDonagh, 7 Mammoth Road reviewed prepared notes that outl= ined his happiness that Mr. William McDevitt had applied for the open Selectman’s position. H= e was hopeful that Mr. McDevitt was appointed to the position.

APPOINTMENTS

Public Hearing: 3-way stop signs at intersections of Shepard Road at Harley Road and Shepard Road and Mulberry Lane

Mr. Danevich began by reading aloud the service reques= t, dated August 10, 2007 which contained three requests: 1) dead end stop sign to be installed= at the beginning of Pete’s Way; 2) dead end stop sign at the intersectio= n of Hillcrest Lane and Melody Lane; and 3) 3-way stop sign at the intersections= of Shepard Road, Harley Road and Mulberry Lane. Mr. Gaydos explained that official= ly adopting the stop signs would give the Police the authority to give someone= a ticket.

PUBLIC INPUT

Ms. Chandia Gretter, 2 Spring Street Extension was con= fused why a three-way stop was being required on the street. She noted that the road sign was incorrectly spelled as ‘Shephard’ when it should read ‘Shepard’. She explained how the roadways were connected and the dangers of the street bas= ed on people not following the rules. She felt adding more stop signs would be a hazard and didn’t s= ee the need for such. She felt a= stop sign should be added at the end of Young’s Crossing at Route 38 becau= se it was currently missing.

Mr. Danevich said the discussion was constrained to the proposed stop signs and wanted to know if Ms. Gretter was in favor of them = or not. Ms. Gretter said she was against it. She felt if stop = signs were going to be added on one thru-way, they should be added to all of them= .

Mike Scanlon, 6 Shepard Road, said he was behind the request f= or the stop signs and represented a minimum of forty families who also wanted = the stop signs. He explained that= Shepard Road was a ten-house subdivision and was not a cut-thru. He discussed the dangerous traffic situation that was occurring and believed that the stop signs were necessary for safety and quality of life.

Mr. Danevich stated that the Highway Safety Committee = had reached a unanimous decision and made the recommendation for the three-way = stop signs. The Selectmen discusse= d the recommendation.

(Lynde/Haverty) To authorize the installation of 3-w= ay stop signs at the intersection of Shepard Road and Harley Road and the installation of 4-way stop signs at Shepard Road and Mulberry Lane.

Mr. Danevich asked that Mr. Gaydos pass the authorizat= ion onto the Highway Safety Committee. He also asked that the spelling of Shepard Road be reviewed. Mr. Lynde also asked that the High= way Agent be notified that there was no stop sign at the end of Young’s C= rossing.

Selectmen Applicants: Mr. Ken Dunne, Brian O’Hearn, Howard Mastropiero, William McDevitt

Mr. Danevich said with the resignation of former Chair= man Gleason, the Board made the decision to back-fill the open vacancy. The term would expire on April 1, 2008. He said the vacancy was posted two= weeks ago and a number of people inquired about it. Of the four applications, one had = been withdrawn. It would have been= a conflict for Mr. Howard Mastropiero to be appointed since he was currently = an On-Call Firefighter/EMT; the Select= men accepted Mr. Mastropiero’s withdrawal from the process.

The applicants, Mr. Ken Dunne, Mr. Brian O’Hearn= and Mr. William McDevitt each came forward to discuss their qualifications and reasons for applying for the vacant Selectman position.

The Selectmen discussed the issues (listed on the Sele= ctmen priority list) that would be discussed from the present date until the Town vote. They also discussed the= qualifications of the candidates.

MOTION:=

(Lynde/Haverty) To appoint Mr. William McDevitt to f= ill the unexpired portion of Edmund Gleason’s term as Selectman which e= nds at this coming March’s election (2008).

Contract Negotiation

Mr. Danevich said the Board had been working during non-public regarding the union contracts.&= nbsp; He said they were coming down to the time when they needed to be dra= fted and come together. Mr. Gaydos= said the contract with the Pelham Public Works employees and Municipal Workers h= ad been ratified by them. He was= now asking the Selectmen to ratify the agreement. He read aloud the changes to the contract and the projected funding.

MOTION:=

(Viger/Lynde) To agree to the tentative agreement re= ached in moderation between the Town of Pelham and the Pelham Public Works Union Local 1801 dated September 24, 2007.

VOTE:

Mr. Gaydos said the second contract that the Town was working on had not been ratified by the Police although through all the discussions they agreed on the numbers.&nb= sp; He felt some wording had to be crafted to memorialize what they were trying to do. He asked the Selectmen to ratify the agreement because he believed it would be the agree= ment that would actually be ratified by the Police. He said if it was not, he would co= me back to the Selectmen. Mr. Ga= ydos read aloud the changes made to the contract and the projected funding.

MOTION:=

(Lynde/Viger) To agree to the tentative agreement da= ted September 4, 2007 for AFSCME Local 3657 and the Pelham Police Department, contingent upon their ratification. – any further changes are to come back to the Selectm= en for discussion.

Warrant Article Voting

The Selectmen discussed the propos= ed article and didn’t feel that the cost could be justified with what the Town currently paid to rent the machine with an operator for the small amou= nt of time it was used.

M. To raise and appropriate $150,000 to erect a communication tower on Jeremy Hill to serve for fire communications. Mr. Lynde said he would need to ab= stain because he owned property on Jeremy Hill and was unsure where the tower was located and how he would be affected. Mr. Viger believed there had= been some question regarding the tower and if the Town had received a permit to build. Mr. Gaydos believed the original location didn’t work out and an alternate location had been found.

The Selectmen decided to= defer and obtain further information.

Fire Chief Michael Walker joined the Selectmen to disc= uss the uses for the tower. He sa= id it could be used for all Town functions. He said the original site was abandoned in lieu of a second, but were having great difficulty finding out who owns the land. Mr. Danevich asked what prompted t= he request. Chief Walker said it= was originally prompted by the fact that the tower was attached to a home; with= a radio infrastructure a secured site is needed. Mr. Haverty wanted to know t= he ‘life’ of the antennae and if there were any plans to move it or not have one in that location after a particular amount of time. Chief Walker said he didn’t = have the technical competencies to be able to answer. Mr. Haverty asked if other locatio= ns were being reviewed. Chief Wa= lker said they weren’t looking at other locations. Mr. Haverty asked how close they w= ere to resolution of the site. Chief Walker said approximately 75% by reviewing GPS. Mr. Haverty asked if there was an immediate need to vacate the current site (that was attached to the home).<= span style=3D'mso-spacerun:yes'> Chief Walker said there was no urg= ent need to vacate; the tower would be a significant step in their strategic planning process to erect their own tower on a secure site. Mr. Viger asked if the requested a= mount would all-inclusive in taking care of the tower infrastructure. Chief Walker didn’t have the= data in front of him but described to his knowledge what would be covered.

The Selectmen deferred taking action to provide the opportunity to rewrite the article to refer to the Town communication so it could be used for Police, Fire, Highway and School.

N. To raise and appropriate $220,000 to refurbish and winterize the clubhouse at Veteran’s Memorial Park. The word ‘clubhouse’ was amended to read ‘main lodge’.<= span style=3D'mso-spacerun:yes'> Mr. Gaydos said Roland Soucy had s= poken with several contractors to find out costs; clearing costs for the access r= oad were also added to arrive at the number provided. He will provide backup for the costs.

The Selectmen deferred action until backup information= was provided for the cost. Mr. Ga= ydos provided the Selectmen with backup data for review. He explained there was a differenc= e in cost so site work to widen the road could be done. Mr. Danevich asked if the article = could contain the same language as the previous which indicated the purpose as be= ing to refurbish the building to extend the life. Mr. Haverty asked if the building = was heated. Mr. Gaydos answered no. Mr. Haverty asked if the intention was to use the building during colder months. Mr. Gaydos said the intention was = to use the building year-round so there would be less vandalism.

To establish a Capital Reserve Fund for the purpose= of constructing a multi-purpose gymnasium facility at Pelham Veteran’s Memorial Park and to further raise and appropriate $100,000 to be placed in that fund. Mr. Haverty questi= oned if the location should not be specified.&n= bsp; The Selectmen agreed that the specific location should be deleted. Mr. Haverty said he appreciated th= e need and what they were trying to do, but faced with other articles was unsure i= f he could support it this year. T= he Selectmen discussed if they would include the article on the ballot. They decided to defer the article = until next year.

P. To ra= ise and appropriate $285,000 to construct two soccer fields at Raymond Park. The project had been approved for = an additional $45,000 grant which would be lost if the article was not approve= d. Mr. Lynde noted that the amount ha= d gone up approximately $40,000. Mr. Gaydos said it was for the engineering of the rest of the park. He believed the cost of the tire d= ump was also included. Mr. Lynde thought they had all the permits to do the soccer fields. Mr. Gaydos said they would have to= reclaim the rest of the area. He said= there had also been a discussion of having an alternate water source. Mr. Lynde asked that more detail be provided in the backup when it went to the Budget Committee.

Q. To raise and appropriate $150,000 to be placed in t= he Senior Center Building Capital Reserve Fund established in 2007. Mr. Danevich said the Council on A= ging met last week and he asked how far to contribute into the fund. He said they would like to get hal= f (the building cost) through the capital reserve fund at which point they wanted = to start working on doing a matching grant/donation for the other half.

Mr. Gaydos said he needed to get a correction of the unfunded liability. A motion was made with the underst= anding that the number would be revised when it went to the Budget Committee.

To ch= ange the status of the Video Service Director from thirty hours per week hours (hour= ly position) to a forty hours per week (salary position) and to raise and appr= opriate $13,000 for that purpose. The= re was discussion regarding if the amount should be in the budget versus a warrant article. The Selectmen deferr= ed until reconsideration and would add a warrant article if needed.

To establish as Town Forest specific par= cels and add them to the existing Town Forest as follows M= erriam Conservation Area – two parcel; Calitri Area – four parcels; = Costa Conservation – two parcels. And to authorize the Forest Committee to manage the parcels as Town Forest and to place any proceeds from forest management into the Forestry Trust Fu= nd to be used for stewardship of said parcels.

To establish a capital reserve fund with the Select= men designated as agents to expend for the purpose of cycled property assessmen= t updates until 2012 and to further raise and appropriate $175,000 to be place in the fund. There was a brief discu= ssion as to whether or not to defer the item.&nb= sp; Mr. Danevich suggested deferring it until the default budget calcula= tion was done. Mr. Viger said the = Budget Committee members were provided with copies of the presentation and had a g= ood idea of what it entailed. Mr. Gaydos said if the amount was put in the operating budget and the Town had a default budget, they would be precluded from being able to do it.

The Selectmen deferred this item.

Y. To raise and appropriate $179,000 for the purpose of obtaining state permits and constructing a second egress at Muldoon Park. Mr. Haverty discussed the importan= ce of including the article on the ballot based on his experiences at the park. <= /p>

Z. To raise and appropriate $170,000 for the purpose o= f updating code compliance in Sherburne Hall. Mr. Viger said when the building was constructed they were told that= the funds would be raised privately. He said the article stated that they were going to bring the hall into code compliance, but noted air conditioning was included in that. He said he wouldn’t support = the article because it included items that surpassed code compliance. He also didn’t feel raising = the specified funds was viable at this point.&= nbsp; Mr. Haverty asked if he would entertain a figure that simply brought= it up to compliance. Mr. Viger s= aid he was opposed to spending any money on the hall because people were originally told that it would be taken care of by private funds. Mr. Danevich said they had come to= the conclusion that it wouldn’t happen and questioned what would happen now. Mr. Viger said he wasn&#= 8217;t convinced that Sherburne Hall was the hall to be updated for that particular purpose. Mr. Danevich said th= e one main asset that drove him to support the article was the stage because it w= as the only one in the Town. Mr.= Lynde felt it was important to get the hall to be functioning for the community b= ut wanted to see if a better figure could be obtained. He also recalled that the Selectme= n were supposed to meet with the people from the Salem Boys & Girls Club to discuss the possibility of getting funds to help generate revenue. Mr. Gaydos said a letter had been = sent and they were scheduled for the next meeting. Mr. Haverty agreed that the hall w= as a diamond in the rough. However= , he was not convinced that all options had been explored to fix the hall up so = at this point, Mr. Haverty wasn’t ready to support the article.

The Selectmen deferred the item to next year.

AA. To raise and appropriate $35,000 to purchase a skid steer and for the purpose of operating moving materials at the Transfer Station. Mr. Danevich asked i= f this item was considered for inclusion on the new capital improvement vehicle replacement program. Mr. Vige= r said it was. Mr. Danevich suggeste= d deferring the item until reconsideration. There was no objection.

AB. To r= aise and appropriate $35,328 to fund a fire emergency command vehicle and associated electronic equipment. The int= ent was that the vehicle was not solely for use by the Fire Chief. Mr. Viger noted that the vehicle w= ould fall under the allowance of the vehicle replacement capital reserve. The Selectmen deferred the item. <= span style=3D'mso-spacerun:yes'>

AC. To raise and appropriate $4744 for a part-time Sec= retarial position at the Fire Department. Amount represents full cost of the position for 10 hours per week fr= om May 1, 2008 thru= December 31, 2008. After approved the position would = be funded through the Fire Department Budget.= This is a new part-time position.&n= bsp;

AD. To raise and appropriate $36,516 to purchase a four-wheel drive pick up truck with plow for use by the Highway Department. Mr. Viger said th= is item could be deferred and tracked. The Selectmen deferred the item until reconsideration.

AE. Reports of the Auditors. – The Selectmen don’t = need to take action regarding such.

Mr. Danevich reviewed wh= ich warrants were deferred and what would not be included on the ballot.

VFW Compliance

Mr. Gaydos said a number of years ago the Town deeded = the old Town Hall to the VFW with the understanding that the VFW would maintain= insurance and keep the building maintained. He said there had been some issues with the Fire Alarm box. He said he had requested and recei= ved a call from Mr. Ouellette indicating that the insurance company would provide= the Town with a copy of the binder. He said he spoke informally with Mr. Charlie Mooskian (VFW Commander) who indicated he was obtaining prices to bring the unit up to code and back wor= king again; he also indicated he would request a waiver from getting the box operational. Mr. Gaydos asked= if granting a waiver was an option that the Town had.

Fire Chief Michael Walker, who was seated in the publi= c, joined the discussion. He sai= d the term wasn’t a waiver, it would be change of occupancy which would change t= he interpretation of the code and what alarm system would be required. He said there had been an alarm at= the facility and when units arrived they found that the fire alarm panel had be= en literally broken open and the battery removed. Not knowing when it was done, or i= f it was intentional, photographs were taken and a Police report was done. Chief Walker said they had a file = that indicated multiple occasions where the alarm company tried to get in contact with the folks to have the work done. He said he issued an Order of Correction which gave the VFW thirty d= ays to come into compliance and on the last day he received a telephone call fr= om Mr. Mooskian. He told Mr. Moo= skian he needed to contact Inspector John Hodge and correct the problems. He believed Lieutenant Fisher was drafting an Administrative Warrant which meant the Fire Department could go into the facility and for every day past the thirty days would be a separate charge for not being in code compliance.&n= bsp; Chief Walker said the date for the Order of Correction had been exceeded. He said they were compelled to draft the warrant and go in.&= nbsp; He said it had been quite some time and Inspector Hodge had made repeated attempts. He said he= also had documentation that the alarm company had also made repeated attempts to access the building.

Mr. Lynde asked what the implication was if the alarm = was inoperable. Chief Walker said= the implication was if a fire broke out it would spread exponentially before an= yone was notified. If it occurred = in the middle of the night the building would be lost.

Mr. Danevich asked if keeping the insurance binder up = to date was one of the agreements in the deed. Mr. Gaydos said it was. He said Mr. Mooskian indicated tha= t he would like to work something out. He said his concern was how the insurance company would view the situation knowing that the alarm system was inoperable. He said Mr. Mooskian would like to= meet with the Selectmen to discuss possible uses for the building wherein they c= ould get some revenue to make some of the changes. He said there would be a problem w= ith occupancy with the fact that the alarm was inoperable. He said it was not the intent to t= arget and individual, but it was the only way they could move forward. He said ultimately if the building= were to burn questions would arise such as when people knew and what they did ab= out it.

Mr. Viger believed the situation was beyond someone co= ming in and discussing options. He= said the Selectmen had to do what was in the best interest of the Town and act u= pon it as they were required to by law.

Mr. Danevich noted that the Town had a vested interest= in the building. He said the que= stion for the Selectmen was if there was a need to meet with the VFW. The Selectmen discussed the situat= ion and didn’t feel it was necessary to meet with the VFW. The Fire Chief will proceed the ac= tions he specified.

P & R Director Update/Schedule

Mr. Gaydos informed that there were thirty seven applications submitted. A spreadsheet would be generated for each of the Selectmen to fill out; the s= ame hiring process as used in the past would be used. Once the field was narrowed down, interviews would be scheduled. Mr. Danevich described the process that the Selectmen had taken during recent Department Head hiring. The Selectmen review the resumes and submit their ‘ranking’ form by= the next meeting.

Mr. Danevich said he printed out the Selectmen Priorit= y List for review. Mr. Gaydos he has= come to realize that there were numerous volunteer that used the Park & Recreation truck. He felt a policy/guideline should be set up (similar to the Senior Center Bus policy). Mr. Danevich suggest= ed placing an action item on the list. There was no objection. Mr. Gaydos said if the Selectmen wanted to work on the water project as a prior= ity, something would be needed at the Town Meeting vote. He said he just started investigat= ing and said there were a couple options, one being the formation of a Municipal Water System (which required a Town vote).

Mr. Danevich read aloud the items contained on the Sel= ectmen Priority List. There was a consensus to adopt the document as of November 6, 2007.&n= bsp; Mr. Danevich said he would publish the document on the website for public review.

Pet Policy Review

Mr. Danevich reviewed the document that had been revis= ed with the amendments made at the previous meeting. He made a couple minor corrections= . There was no objection to how the document read. Mr. Gaydos was= asked to distribute the document at the next Department Head meeting. The document was officially enacted on Octo= ber 23, 2007.

TOWN ADMINISTRATOR / SELECTMEN’S REPORTS

Mr. Gaydos had nothing t= o report other than a lot of progress had been made with the contracts.

Mr. Viger said the Budget Committee was in the process of reviewing the School budget.

Mr. Haverty said the Planning Board had a legal review= and update at the last meeting. H= e then reported the Fire Station Committee was just about done with the cost estimating for construction. = They were reviewing the soft cost pricing.   They estimate a presentation= would be ready for the Selectmen next Tuesday.&n= bsp; Mr. Lynde felt it was important to have a figure/cost estimate of mo= ving the current fire station. He = said it would be a valid number to look for compensation if there was sufficient money left over in the project. Mr. Gaydos said they weren’t ready to come up with an actual number, but = they could give an idea of where they were at.&= nbsp; Mr. Haverty said he would look into it.

Mr. Danevich said he had meeting with the Counsel on Aging = and they discussed their philosophy regarding the building capital reserve fund. He also reported that t= he Fall Festival did well and a good time was had by all.

REQUEST FOR NON-PUBLIC S= ESSION

The Selectmen briefly discussed if there would be a pr= oblem with Mr. McDevitt entering into non-public session because he was newly appointed as a Selectman but not yet sworn in. Mr. Danevich said he could be acce= pted in; he wouldn’t be voting.
