A= NNOUNCEMENTS

Mr. Danevich informed that the tax rate had n= ot yet been received from the state, but it was expected in the next week (or so).

Mr. Gaydos said the Town had spoken to the st= ate regarding EEE; they indicated that the probability was decreasing with the= cold weather, but there was still a probability that it was in existence. He said people should use their observations with EEE and West Nile Virus. To date Pelham has not had a positive test, but it was believed that EEE and/or West Nile Virus may sti= ll be present without a positive test since it had been found in surrounding towns.

Mr. Gaydos said they went out and got three b= ids for the Fire Station roof repair. <= /span>They are looking to award the bid to the low bidder (a company from Dracut, MA) who came in at $24,000. Seve= ral plans/options were being reviewed with regard to the mold mitigation. The Selectmen will schedule an ag= enda item for further discussion.

APPOINTMENTS

Patti Marchi Re: Travel Soccer

Ms. Pat Marchi, (Mammoth Road) Treasurer of the Granite State Youth So= ccer League Program met with the Selectmen to discuss the fact that the program= was considering Pelham as one of the Towns to donate $100,000 toward the Steph= anie M. Chakar soccer fields. She= let the Selectmen know that the board was greatly concerned with the issue of = hunting in the Raymond Park area. Sh= e said they wanted to know the Selectmen’s position regarding the hunting a= nd if hunters were allowed, they may need to reconsider the consideration of the grant. Mr. Danevich said at = the last meeting, the Selectmen (on a 4-1 vote) decided not to allow hunting.<= span style=3D'mso-spacerun:yes'> He said they would be reviewing t= he ordinance (later in the meeting) to consider a change in the definition of ‘Firearms’. Ms. = Marchi said they were also looking to review finalized plans (indicating how many fields and what size) for Raymond. Mr. Gaydos said they didn’t do a design for the entire facili= ty and didn’t know when it would be done because there was no funding f= or such. Ms. Marchi asked if th= ere was a vision for the area. Mr. D= anevich said they were taking one step at a time with the preliminary plan when fu= nding became available. Mr. Lynde = said there had been some concepts considered, but until the current fields were constructed it would be difficult to get to the next step. He discussed some of the options,= but each would require further review. = Ms. Marchi said they were having a problem with facilities closing down. There was further discussion rega= rding the need to determine the types of programs wanted in the community and wh= at programs were currently available. =

Mr. Bergeron asked if travel soccer was private. Ms. Marchi said the soccer league= was comprised of approximately 473 teams from around the state. She said it was an elevated compe= titive league versus recreation. Mr. Bergeron questioned how many towns participate. Ms. Marchi said there were over thirty-five towns.

Mr. Domenico asked how scheduling would be done. Ms. Marchi said field coordinatio= n would be done with the Park & Recreation Department. Mr. Domenico said it was importan= t to establish a dialogue to come up with a plan for the park. He proposed that a Selectman work= with Ms. Marchi and Park & Recreation moving forward. Ms. Marchi said they would like s= ome sort of blue print showing what the end result would be; their interest was that the park would have a soccer complex. Two fields wouldn’t suit them; four or five fields (11V11) wo= uld be needed. Mr. Danevich said= the Town appeared to be stuck in the middle given the fact that the group couldn’t provide a letter of commitment and the Town wouldn’t = have finalized plans without funding. Mr. Domenico and Mr. Lynde will coordinate information. Ms. Marchi noted that the money h= ad already been placed in a bond, they were just looking to ensure that there= was a plan in place.

Public He= aring: Changes to Regulations Prohibiting Hunting and Discharge of Firearms in To= wn Parks

Mr. Danevich said the only changes being proposed wer= e under Definitions as follows: 1) to add Pelham Veterans Memorial Park to the definition of Town Park; 2) to remove Pepper Gas or Mace from the definiti= on of Firearm; and 3) under Exceptions, add ‘trapping with the written permission of the Board of Selectmen in order to manage species of wildlif= e provided noticed postings are made at each point of entry to the park advertising t= he activity’.

Prior to the meeting, Mr. Domenico received a phone c= all from a frantic resident who perceived that she had been shot at by a shot gun. The Police are investig= ating the report. He wanted the Se= lectmen to be aware that there were ongoing issues in the park which should be act= ively monitored.

Mr. Lynde offered some grammatical corrections to the document.&= nbsp;

Mr. Bergeron recalled the Selectmen discussing that advertised bow and arrow events would be permitted and wanted to know if t= hat was correct. Mr. Danevich no= ted that #2 adequately covered that situation as long as they had prior approv= al from the Selectmen and the Recreation department.

Mr. Gleason supported t= he changes being proposed.

Playground Grant for Lyons Park

Park and Recreation Director Darren McCarthy said he = had sent the Selectmen and Mr. Gaydos a memo dated October 23, 2006 containing informati= on about a grant received from Hi= llsborough County that needed= to be signed. He also requested permission from the Selectmen to apply for a grant called Fighting Obesity= Through Play. The request was for $6= 000 with the deadline being November 15, 2006. Mr. Mc= Carthy said the playground became apparent when the Park & Recreation 7-year = plan was created. The playground = at Muldoon was specifically designed for children aged 5-12 and a lot of the structures were too big for toddler between the ages of 2-5. A conceptual depiction of the pla= yground was displayed.

Mr. Danevich asked why Lyons Park was considered. Mr. McCarthy= said the 7-year plan showed the majority of facilities being located on the west side of Town; there was no facility in the center serving the residents. He felt Lyons Park would be completed once the emergency shelter and lights were put in at the skate park and the playground was installed. Mr. Danevich wanted to know if th= ere was a potential for clashing the different age groups together. Mr. McCarthy didn’t believe= there would be problems because the playground would be located near the entranc= e of the park (far away from the skate park and basketball courts). Mr. Danevich wanted to know if Pelham Veterans Memorial Park woul= d be good for the playground. Mr. McCarthy felt the west side of Town was already well served.

Mr. Gleason confirmed that $10,000 was currently in t= he 2007 budget and wanted to know in the event of a default budget, if there would= be adequate funds in the budget to cover it.= Mr. McCarthy said in the event of a default budget the remaining mo= ney would have to be privately raised. Mr. Gleason wanted it noted that a commitment would be made with Hillsborough County once the grant was signed.= Mr. Domenico believed that the Pa= rk & Recreation budget would end up higher than what was requested in the event of a default budget. P= ark & Recreation would benefit from a default with their budget ending up = $175,273 higher.

Mr. Danevich wanted to know if the playground would a= ffect the right-of-way for the Senior Center expansion f= or communication. Mr. Gaydos didn’t think it would be affected.&= nbsp; He said the final design would take it into consideration. Mr. Danevich questioned who would= do the fundraising (if needed). Mr. McCarthy said it would be done through the fund raising efforts of volunte= ers. Mr. Danevich noted that use of a = Town employee wouldn’t be correct. He confirmed that there wouldn’t be extra burden on staff, printers, paper etc. Mr. McC= arthy understood.

Mr. Danevich questioned what Mr. McCarthy was request= ing from the Selectmen. Mr. McCa= rthy said he would like signatures on the Hillsborough County Grant ($10,000 grant); and also permission from the Selectmen to send a purchase order in for the Fighting Obesity Through Play grant (which is due November 15, 2006 to qualify for additional $6000).

Mr. Gleason asked if the purchase order was for a spe= cific amount of money. Mr. McCarth= y said the purchase order was for the specific playground components. The cost of the playground delive= red is $13,475. It was noted that c= osts could be incurred on January 1, 2007 of up to one quarter of the total Park & Recreatio= n budget. Mr. Gaydos asked when the Town wo= uld be eligible to receive the = Hillsborough County grant. Mr. McCarthy said he had it now, = and as soon as the check was signed and a receipt was sent showing that the equip= ment was purchased, the money would be sent.&n= bsp;

OTHER BUSINESS

Discussio= n – Use of a portion of Fire Impact Fees to obtain a ‘not to exceed amount’ for Central Fire Station Completion

Mr. Danevich clarified that it had been reaffirmed th= at no money had been spent from the impact fees. He said the proposal was to review the impact fees to help obtain a= set of plans to answer basic questions such as where a station would go, where= it would fit, what it would look like, sizing etc. He said the Selectmen would discu= ss using a portion of the impact fees and obtain a ‘not to exceed’ amount, and if the Board chose to, there may be a warrant article on the ballot.

Mr. Gleason felt the sooner the process began to get = a fire station (given the existing problems with the roof and mold) the better. He felt the Selectmen should move forward with a warrant article (on the 2007 ballot) based on a ‘not to exceed’ price with the understanding that there would be adequate time for citizen input so the particulars cou= ld be discussed.

Mr. Danevich questioned what amount was being propose= d for expenditure. Mr. Gaydos said= the budget number was $103,500, but was confident that they could come in under that number. He said a good surve= y of the property would be needed as well as some test borings. The utilities and layouts also sh= ould be double-checked. He said the invoices and a plan would come before the Board.

Mr. Gleason supported the number with the objective t= hat it be a warrant article on the 2007 ballot.&= nbsp; He wanted to make sure that there was a ‘not to exceed’ price and a data package sufficient to satisfy anyone who wanted to review= .

Mr. Bergeron said when the architect met with the Sel= ectmen, he asked if it was possible to get a footprint and plan of what the buildi= ng would look like based on the information that was already done (by the committee). When he asked the architect if a plan could be done by choosing a ‘not to exceed’ number, and he recalled the architect saying that it wouldn’t be wor= th the paper it was written on because it wouldn’t have all the details= of the building. He said to hear discussion about using $103,000 to create a plan when the architect had discussed moving forward with $509,000 for a plan. He felt if that was what was need= ed, it should be put to the taxpayers in a warrant article. Mr. Bergeron then addressed the c= omments about possibly not putting any more money into the current fire station an= d/or the Annex (old fire station). He pointed out there was mold reported in the fire station and other maintena= nce needed in both buildings; in his opinion it was a bad thing to let the buildings go because they needed maintenance. He hoped the Board would move for= ward to fix the crucial buildings that needed to be fixed since it was unknown how= long the buildings would be used. Mr. Bergeron said at this point, to move forward, he would be in favor of spen= ding $10,000 - $15,000 which would mean just as much to achieve what was curren= tly being discussed at a cost of $103,000.&nb= sp; He felt the voters should make the decision to take a portion of the impact fees (that took years to raise) because the future years may not se= e the same kind of revenue. He fel= t the current buildings should be maintained.&n= bsp; Mr. Bergeron believed the $509,000 study would provide the specifications. However, he wasn’t willing to spend that amount without the vote of the taxpayers. He pointed out if= that study was done and the station was turned down, the money would have been lost. He said from the start= he supported substations which could be done for as little as $1million. Mr. Bergeron reiterated that a few thousand dollars for a study was worth the same as $103,000.

Mr. Domenico wasn’t inclined to wait another ye= ar to put it on the ballot and incur a minimum of $500,000 cost inflation of the project. He didn’t fee= l it was the right thing to do to the taxpayers. He said the committee worked for = over two years developing the plan and with the new Chief determined a central station was the course they wanted to follow. He didn’t feel the tax rate= had anything to do with the decision; it was a public safety decision. He said the conditions of the cur= rent facility were deplorable and had hundreds of thousand dollars worth of equipment sitting outside in the elements. Mr. Domenico said he intended to support the $103,500 which he felt= was reasonable based upon the deliverables discussed by Mr. Gaydos. The only contingency he suggested= was to move forward and get the information to the Budget Committee so they could= make an informed decision as to whether or not to support such. He said Mr. Gleason (being the Se= lectmen Representative to the Budget Committee) should be given as much informatio= n as possible to let the Budget Committee know the Selectmen’s position.<= span style=3D'mso-spacerun:yes'> He said if the Selectmen vote to = expend the funds, they should have a meeting with the Budget Committee to apprise= them of the Board’s position. He said the Selectmen had taken a vote and indicated that the fire station wa= s the highest priority capital project and it was incumbent for the Board to get= it done.

Mr. Lynde asked for a list of items that would be cov= ered with the $103,500. Mr. Gaydo= s said the proposal previously discussed by the architect for the amount of $509,000 = would cover from the beginning to ribbon cutting. He said the architect was asked w= hat was needed to get a good ‘not to exceed’ number. He said programming, review of the space, survey, test borings, geo-technical supports, but the biggest part = was the schematic design alternatives. Mr. Lynde asked if there were detailed construction drawings, a bid package could be put together with accurate numbers. Mr. Gaydos answered yes. Mr. Lynde said with the informati= on, a bid package could be done within 5%-10% of the cost. Mr. Gaydos believed the bids may = be 5%-10% higher, but there would be areas that could probably be cut; there = would be a process of doing such. = Mr. Lynde was in support of the $103,500.

Mr. Gleason’s interpretation of what the archit= ect said was that he couldn’t give a ‘not to exceed’ based u= pon not having more money; if he was to go back and put something together from what he had now, it would be meaningless.= He interpreted the information to read if items/phases were funded = (up through stage 8) the $103,500 expenditure would yield enough information t= o be able to get a ‘not to exceed’ price (which would be on the high side because of the inclusion of contingencies). Mr. Gleason said this would be on= the ballot in March. He believed= this was the logical approach to the project and if it was delayed to await app= roval of spending the impact fees, the project would be delayed (in effect) two years. He said the comments = he had received from the public was questioning why the Selectmen weren’t d= oing something about the fire station. He discussed the current facilities and believed the Town was past = the approach of being frugal. He= said the initiative should be supported; the voters would have the right to vote.

Mr. Bergeron said he asked the question if the proces= s could be done for less and the architect said no, it wouldn’t have was the= Town needed in it; but now it was being said that for $103,500 he could give the Town something. He said he h= ad done homework and found something could be done for a lot less. For that reason, Mr. Bergeron cou= ldn’t support the $103,500, but noted he would be able to support something in t= he $15,000 range which would provide information such as a ‘not to exceed’ number, footprint and they could see what the building would= look like. He said the Selectmen = would hear what would, or would not pass in March. He wanted to give the voters some= thing to vote for and felt this could be achieved by using a lot less money.

Mr. Domenico said the Town wouldn’t be saving a dollar, it would actually be spending two because one would be spent on maintenance and band-aids and the other would be spent when the time came = to solve the problems. He said = the fire station wouldn’t ever be less to build than it was today. He said the other issue was to pu= t the plan out to the community to review/evaluate and have input regarding the plan. The constraint would b= e the ‘not to exceed’ amount authorized by the voters, should they c= hoose to support it. He said the Selectmen should show leadership regarding the issue; this could be done by putting a proposal in front of the voters. He felt the need was clear and incumbent upon the Selectmen to do so.

Mr. Lynde said the money would either be spent now, o= r next year. He said the same proce= ss would be done to get the station designed properly to go out to bid, and t= he sooner the issue was tackled, the better off the Town would be.

Mr. Danevich believed the Selectmen were in agreement= that pubic input was important. He wanted it to be clear that the Selectmen were not obligated to go through a public hearing process and it didn’t require a warrant article to ex= pend the impact fees. This has be= en confirmed by legal counsel. = Mr. Danevich discussed the feedback he had received from the public, which was= to ask the Selectmen to stop putting money into the current fire station. He discussed the general state of= Town buildings and said the buildings were in neglect and if pro-active steps w= eren’t taken there would be other similar emergency repairs. He said everyone came to the same conclusion that a new building was needed. Mr. Danevich supported the proposal and suggested that the Selectmen conduct a public hearing prior to making any decisions or taking a formal vote. He said any form of fe= edback from the public was welcome.

Mr. Danevich asked if the Board had an objection to scheduling a public hearing and not taking any action at the present time.= Mr. Gleason asked if the Selectme= n could vote the night of the public hearing.&nbs= p; Mr. Danevich answered yes. There was further discussion regarding when to hold a public hearing. It was decided to s= chedule a public hearing on Wednesday, November 8, 2006. The Selectmen also discussed the proposed time line. Mr. Gaydos didn’t feel that= the work through the eight stages could be done by November 20, 2006 for the Budget Commi= ttee; however he would speak with the architect to find out what could be done g= iven what they had to work with. =

Mr. Bergeron said he would like answers to the follow= ing questions: 1) What is the ‘not to exceed’ number? and 2) If the decision was made to move forward with the $103,500 would the balance of $= 405,500 be due at some point in the future? Mr. Gaydos said the Town wasn’t committing to any future step= s; this section of the project was being funded the Town was not committed to continue with it. Mr. Berger= on asked if the number would then be picked up if the Town voted yes. Mr. Gaydos said it was his unders= tanding that the architect was selected by the committee when they went through the selection process. He said i= f the Board wanted to have no commitment to continue with the architect and have= them only do this work, it could be part of the agreement. Mr. Bergeron felt it was importan= t to investigate now before moving forward.&nb= sp; Mr. Bergeron felt the public should know if there were any ties for payback. Mr. Gaydos said any= funds spent in that field would reduce the total architectural budget. Mr. Bergeron asked if there was a ‘not to exceed’ number. Mr. Danevich answered no.

After further discussion, the Selectmen decided to ho= ld a public hearing on November 8, 2006. Mr. Gay= dos was asked to work with the architect to create a realistic schedule.

Warrant Article Discussion

The Selectmen reviewed the proposed 2007 Warrant Arti= cle list as drafted. The article= s were in no particular order:

Mr. Gaydos was asked to reprioritize the list for further review at the next meeting.

Castle Hill<= /st1:PlaceType> Bridge Agreement with Windham

Mr. Gaydos said he had discussions with Windham’s Town Administrator (Da= ve Sullivan) regarding how to proceed with the construction of the Castle Hill Road bridge. He said there was a contractor with a project in Windham and = part of his approval process (which hasn’t been done) would be for him to pa= y the Town’s and Windham’s share to construct the bridge. Mr. Gaydos said his discussions with Mr. Sullivan had been summarized through documentation. He read a por= tion of the documentation aloud which questioned how to proceed: 1) Town of Pelham support a warrant article to raise half the funds and later being reimburs= ed by the Department of Transportation and the local developer – Windham w= ould do the same; or 2) Town of Pelham (through the Selectmen) authorizes Windh= am to work within Pelham’s right-of-way to complete the work – Windh= am would raise the funds and be reimbursed by the state and the Town’s = share would be paid for by the local developer.= Mr. Gaydos preferred the second option as long as there was a veto = power the Board would have to review the plans and their implementation.

The Selectmen discussed= the project there was a general agreement regarding the second option.

Proposed for Permitting Wetlands Crossing at Muldoon Park

Mr. Gaydos said he would contact the engineer and req= uest an overall cost that could be placed on a warrant article. The assumption was that the = alignment was directly across from = Hancock Lane. Mr. Danevich said another item to revisit was potentially expending funds this year. Mr. Gaydos = said some funds would have to be expended to prepare the estimate. Mr. Gleason asked if there were f= unds remaining in the recreational funds. Mr. Gaydos believed there was and would review such as a possible funding source.

TOWN ADMINISTRATOR’S REPORT/SELECTMEN’S REPORTS

Mr. Gaydos reported that the <= st1:PlaceName w:st=3D"on">Tallant Road Bridge project had= been completed early. The budget = cost is still being reviewed; the applications will be prepared to get the 80% back from the state. He said the = Castle Hill Road Bridge is also being worked on.

Mr. Domenico noted that the single-family home starts= had slowed significantly; however the Planning Board was in the process of dea= ling with hundreds of 55+ units on several different proposals. Several of these proposals are lo= cated on Sherburne Road which will put the two intersections further into failure. The options are being evaluated. =

Mr. Bergeron reported that he attended a workshop October 19, 2006 to review transportation solutions to alleviate congestion through Pelham’s Town Center. The process being used is Context Sensitive Solutions to solicit public input for the transportation project. Mr. Bergeron discus= sed what occurred during the workshop and thanked the DOT, the residents for attending, various others that were involved and Hammar Signs for donating signs. There will be additio= nal public workshops held.

Mr. Gleason discussed the results of the Budget Commi= ttee review. He then read aloud a= memo that was sent to all the department heads after the budget review was completed.

Mr. Lynde said he also attended the traffic center me= eting and found it interesting that everyone had the same viewpoint to make the center a welcoming site and focal point for the Town.

Mr. Danevich informed that he provided the Selectmen = with an updated copy of the Technology Plan and asked that the Selectmen review for possible adoption.
