MOTION:=

(Gleason/Bergeron) To approve the March 28, 2006 meeting mi= nutes as amended.

Amendments to the minutes were as follows: page 1 R= 11; under the motion for the March 23, 2006 minutes: the word ‘public’ was inserted, a= nd after the words Mr. Bergeron abstained the following was added ‘becau= se he was absent for the meeting’; page 5 – under Lyons Park Con’t.: the words ‘even though there were no lights’ was replaced with ‘Nobody was using the skateboard park probably because there were no lights.’; the words ‘…given the present condition..’ were inserted into: ‘..whether lights should be installed given the present condition.’; there were also minor grammatical changes made.

OPEN FORUM=

Fire Chief E. David Fisher informed that there had bee= n a brush fire over the weekend, which consisted of approximately 60 acres. He updated the Board about the mut= ual aid used to put the fire out. There were 120 different firefighters on the scene from various towns; Pelham had= control and command of the overall operation. The possible cause was ignition from an ATV/4-wheeler; this is still being determined. Chief Fisher identified all of the towns that were involved and commended all of the men= and women of the departments. He = said there was over 1000-feet of hose and foam that would have to be replaced.

Mr. Danevich asked that the Chief extend the Selectmen’s thanks to his staff.&nbs= p; He said if any accommodations/recognitions were going to be sent. Chief Fisher answered yes.

APPOINTMEN= TS

Zoning Boa= rd of Adjustment

Ms. Lana Pali= y came before the Selectmen seeking reappointment to the Zoning Board of Adjustment. She discussed her qualifications and reasons for requesting reappointment. Mr. Gleason asked what problems th= e Board of Adjustment would face in the next two years. Ms. Paliy said because the communi= ty had expanded, there would be more variances requested. Mr. Gleason asked if the Selectmen should be reviewing anything that would support/reinforce the Board of Adjustment in terms of regulations/support. Ms. Paliy said it was sometimes difficult to determine where/what went wrong and felt there had to be a bet= ter way for people to find out the issues with their property. Mr. Gleason asked if Ms. Paliy felt strengthening Code Enforcement would help.= Ms. Paliy said it may and discussed the problems with wetlands buffers. There was a question= if Ms. Paliy’s appointment actually expired in 2006 or 2007; Mr. Danevich noted that the Town Report indicated Ms. Paliy’s appointment expiring= in 2007. Ms. Paliy was asked to = come back for reappointment in 2007.

Mr. David Hen= nessey met with the Selectmen discussed his qualifications. Mr. Danevich said there had been a= lot of flack and he had been asked why there was a realtor on the Board of Adjustment. Mr. Hennessey sai= d he personally did no business in Town and his office did very little. He felt some of the problems he sa= w were as a result of realtor’s ignorance; he said he could help get the word out to realtors for what they should be instructing their clients/customers with regard to zoning enforcement. <= /span>Mr. Danevich asked if Mr. Hennessey had any conflict of interest, holdings or oversaw any financial deals on properties.= Mr. Hennessey doubted that he would ever have a conflict, but if he = did he would recuse himself.

Mr. Lynde asked if Mr. Hennessey concurred with the ne= ed for applications to be consistent. Mr. Hennessey believed fairness would be overlooked if the Board wanted consistency. He said due to r= ecent court cases (e.g. Simplex) changed the way that the law was applied. Mr. Lynde noted that one of the ha= rdship criteria was that no diminution of abutting property would occur. He asked if Mr. Hennessey’s expertise came into play with that issue.&= nbsp; Mr. Hennessey answered yes. He said there were two major cases in the past two years; 1) cell to= wer; and 2) water front property / view of lake.

Mr. Gleason asked what problems the Town would face in= the coming years and what he would like to see in terms of support of the Selectmen. Mr. Hennessey said= one of the major things was the amount of situations where people have built in= to ‘no-cut’ zones and the Board of Adjustment had to make the deci= sion whether or not to allow it. H= e said it was a balancing act and the board was requesting input from the Conserva= tion Commission. He then discussed= the Town center given the Boccia case and the way the area was zoned. He would like to see re-zoning in = the Town center.

Mr. Bergeron asked if Mr. Hennessey agreed that decisi= ons should be made, based on the information that came from public hearings and judge each case on it own merit without outside influence. Mr. Hennessey said a case had to be judged based on what was presented to the board; however, the state allows = for personal experience to bear on the case.

Mr. Domenico asked if there was anything that the Sele= ctmen could do better. Mr. Hennesse= y said the Planning Director was keeping the boards informed of classes/seminars.<= span style=3D'mso-spacerun:yes'> He would like sessions with Town C= ounsel to discuss court case decisions.

Planning B= oard

Mr. Danevich reminded the Board and residents that wit= h the passage of the petition Warrant Article to elect the Planning Board, any appointment will be for a term of one year.

Mr. Bill Scan= zani said he had been on the Planning Board for approximately twenty-five years and h= ad helped make some of the zoning changes that protected the Town, but he felt there was still a lot to do. = He was concerned with the state’s projection of the Town’s growth for = the next twenty years.

Mr. Lynde asked if there was a way for the Planning Bo= ard to address some of the wetland encroachment issues. Mr. Scanzani agreed that it was a problem and enforcement was able to be controlled during development, but believed some of the violations occurred when individual land owners took control.

Mr. Gleason said the Selectmen had heard concerns about growth, the lack of moderate-income housing and an influx of elderly people= and questioned what the Planning Board would do to proactively address the concerns. Mr. Scanzani said t= he Planning Board was trying to enact and get the voters to agree on what the state wants to do relative to ‘smart growth’. He said the direction to go would = be to create tighter subdivisions with more open space and less public roads to m= aintain. Mr. Gleason said with only 3400 buildable acres remaining he questioned if the Planning Board would still insist upon single-acre zoning or pressure it toward 55+ developments. Mr. Scanzani said there were three initiatives the Planning Board would like to take this year, one being the zoning in the Town Center, two being reviewing smart growth, and three upscale the business district.

Mr. Bergeron asked what Mr. Scanzani’s view was regarding Conservation Development. Mr. Scanzani said two years ago, with the help of the Nashua Regional Planning Commission (‘NRPC’), 130 lots (5+ acres) that would be considered useful for open-space developments. He felt it was important to ‘cluster’ them and keep the green space open.

Mr. Domenico asked if he shared the concern (with Mr. Hennessey) regarding the = Town Center and keeping = its rural character and if it was something that could be tackled in the next year. Mr. Scanzani agreed wit= h the concern and said once it was lost, it would be gone. He said the traffic pattern and development would have to be reviewed.&nbs= p;

Mr. Lynde asked what the allowed density for 55+ devel= opments was compared to standard zoning/open space. Mr. Scanzani said the maximum numb= er of units on a five-acre lot would be up to forty, based on soil types; however, 30% had to be maintained as open space.&nb= sp; Mr. Lynde asked it Mr. Scanzani felt it was too dense. Mr. Scanzani said there wasn’= ;t a lot of history for the 55+ development, but didn’t feel that the plans that came before the Planning Board would end up being too dense. He also believed that it would pro= vide for lower-cost housing and a substantial amount of the lot to stay open.

Mr. Gleason asked when the Town Center would be rezoned because he didn’t want to see the state’s effo= rts impacted. Mr. Scanzani said z= oning was separate from what happened on the roads. He believed the state would leave = the decision regarding the roads to the Town through public hearings.

Zoning Boa= rd of Adjustment

Mr. Robert Mo= lloy discussed that he was currently an alternate member of the board and would like to be= a full member. He discussed wha= t he had learned over the past year. He explained how he applied the ordinances and also believed that the members needed to take a human look at what was being presented.

Mr. Domenico asked what the biggest surprises were dur= ing Mr. Molloy’s first year on the board. Mr. Molloy said what he saw was the amount of ordinances and how complicated/specific some of the issues could be. He said it was very impor= tant to become knowledgeable about each case.&n= bsp;

Mr. Bergeron asked if Mr. Molloy agreed that when maki= ng a decision about a case the members shouldn’t be influenced by non-abutters. Mr. Molloy said= all the facts should be brought forward in the hearing for everyone to see. He said as a member it was critica= l to maintain liability/credibility.

Mr. Gleason asked within the past year how many times = Mr. Molloy had been called on to fill in for a permanent member. Mr. Molloy said approximately 6 -7 meetings. Mr. Gleason asked w= hat Mr. Molloy perceived as the biggest problem facing the board in the next fi= ve years and what the Town could do to alleviate such. Mr. Molloy believed it was growth = and some of the ordinances were difficult to navigate through. Mr. Gleason questioned Mr. Molloy = how he felt about 200-foot frontage. Mr. Molloy agreed with 200-foot frontage and felt it maintained the character of the Town, but understood that there were certain situations that a variance could be granted for such.

Mr. Bob Haver= ty met with the Selectmen to discuss the reasons he was interested in becoming a member of the Board of Adjustment. <= /span>

Mr. Gleason asked what Mr. Haverty felt were the press= ing issues of the Town and what had to be done to address such. Mr. Haverty said after hearing two= other people speak about the board felt that there should be consistent, uniform, application of the law.

Mr. Bergeron asked if Mr. Haverty would base his decis= ion/vote on what comes out in a hearing, and not from outside influence. Mr. Haverty felt that a hearing ha= d be defined as something outside the confines of a room (in an evening) and oft= en details were found after a meeting either through site visits or walks. To the point, he said he would try= to apply the law uniformly and consistently.&= nbsp;

Mr. Domenico asked what the biggest challenges the boa= rd would face over the next several years.&nb= sp; Mr. Haverty said some of the issues the Town would face was land bei= ng used up and how to deal with such in a fair and uniform fashion.

Planning B= oard

Mr. Ken Dunne= discussed the reason he was interested in switching from an alternate to a permanent member of the Planning Board.

Mr. Gleason asked what experience/personality trait Mr. Dunne would bring to the Planning Board to enhance it. Mr. Dunne said he tried to bring t= he ‘technical jargon’ down to a level that was user friendly for residents. Mr. Gleason questi= oned what Mr. Dunne considered as the serious issues coming before the Planning Board in the next few years. = Mr. Dunne said because the board would be elected, he felt more developers would run for the positions. Mr. Gl= eason asked what Mr. Dunne considered the role of the Conservation Commission to be. Mr. Dunne felt it was goo= d that the Conservation Commission was a separate board, but felt they should be incorporated into the planning process.&nb= sp;

Mr. Domenico asked Mr. Dunne what the biggest surprise= was for him during his first year on the Planning Board. Mr. Dunne felt the Planning Board h= ad more of a range to stop development, however, that could not be done due to state statutes and zoning laws.

Mr. Bergeron asked how Mr. Dunne felt about Conservati= on Development. Mr. Dunne said t= he board currently reviewed open space, felt it was important and agreed with = the concept.

Forestry C= ommittee

Mr. Danevich said this had been a dormant committee, b= ut there had been a lot of interest in the past 12 months as more property was moved into Town management/forestry.

Mr. Bob Lamou= reux came before the Selectmen to discuss his application for the Forestry Committee. Mr. Gleason asked = what Mr. Lamoureux perceived his role on the committee to be. Mr. Lamoureux said he was interest= ed in ‘staying with’ recent property purchased and was also wanted to follow up on the trail systems throughout the Town. He said if anything else came up he would use his common sense. <= /p>

With regard to the trail system, Mr. Domenico was conc= erned with the ATV use and wanted Mr. Lamoureux to take it to consideration.

Mr. Danevich said state law was specific with regard t= o a forestry committee.

Mr. Lynde asked if Mr. Lamoureux was familiar with the logging process and if he would like to see anything changed. Mr. Lamoureux said the people invo= lved with the process knew what they were doing but noted that it took a long time.

Planning B= oard

Tom Collins discussed his qualifications and reasons for seeking an alternate position = on the Planning Board. He said b= eing a Nashua Regional Planning Commission (‘NRPC’) representative, he wanted to become more active and understand the process better. He wanted the Town to participate = more with NPRC. There was a brief discussion regarding the term for NRPC representatives; Mr. Collins was appointed for three years, however, NRPC considers appointments for four years. Mr. Danevich said ther= e was one vacancy to NRPC and Mr. Collins should be asked if he wanted to re-appl= y or extend his term. Mr. Bergeron= noted that Mr. Collins was on the NRPC Executive Board. Mr. Danevich didn’t see any problem with extending Mr. Collins’ term for one year. There was no objection.

Mr. Domenico asked what experience Mr. Collins would t= ake from NRPC to the Planning Board. Mr. Collins discussed NRPC’s planning and the fact that Pelham= was left out of the loop because of the congestion. The other towns are discussing bike paths and connecting trail systems. Mr. Collins wants to be able to inform the other towns how Pelham de= alt with growth issues.

Mr. Gleason asked if Mr. Collins was ready to ‘t= hrow himself into’ the planning board because it was a time consuming activity. Mr. Collins said as= an alternate he didn’t know how often he would be called on to vote. He said he would have no problem b= eing involved.

Ms. Robin Bou= sa discussed with the Selectmen her reasons for seeking reappointment to the Planning Board.

Mr. Lynde asked if Ms. Bousa felt the planning board s= hould address the transportation issues. Ms. Bousa said the board had to review each individual application a= nd the impacts. She said the boa= rd, over the last couple years, had requested that developers contribute to tra= ffic impact studies.

Mr. Gleason asked how Ms. Bousa felt about the zoning = in the Town Center and a solution. Ms. Bousa was in full agreement of changing the Town Center zoning. She said roadway improvements and pedestrian mobility were needed. Mr. Gleason asked Ms. Bousa’s philosophy about senior housing. Ms. Bousa felt senior housing was something the Town needed. She would like to see the properties well developed and not ‘maxed’ out.

Mr. Bergeron asked how Ms. Bousa felt about Conservati= on Development. Ms. Bousa felt i= t was wonderful and the Town should find ways to make it attractive to developers= to do so.

Mr. Domenico asked what the three most significant pla= nning challenges the Town would be facing. Ms. Bousa said all the easy lots have already been developed; the pl= ans coming forward contained challenging lots.= She said the Board was also faced with dueling attorneys and enginee= rs which was a lot to sort through as a board. She believed having an elected boa= rd would be a challenge because people may think they could stop growth by bei= ng elected.

Forestry C= ommittee

Ms. Gayle Plo= uffe discussed her reasons for requesting re-appointment to the Forestry Committee. She was one of the original member= s and felt quite a bit had been accomplished regarding open space and Town forest.

Mr. Gleason asked what Ms. Plouffe envisioned as the r= ole of the committee. Ms. Plouffe sa= id it was management of the forest resources.&nb= sp; She said it was nice to have forests in the different quadrants of t= he Town. Income is generated and placed into the forestry fund. She said the plans lasted ten years and some of which were coming up. She said wetland protection, fores= try and conservation all worked together.

Deb Waters met with the Selectmen to discuss her interest in being appointed to the Forest= ry Committee, which was mainly due to the recent parcels placed into forest management and their integration into a larger picture.

Mr. Domenico asked what the Covert Program was. Ms. Waters said it was a selective= program with people from all over New Hampshire participating. She attended the program in 2001 a= nd was able to see forest management in action.&n= bsp; Mr. Domenico asked if the program would be beneficial for others as = the forestry program expanded in the Town.&nbs= p; Ms. Waters answered yes and noted one other individual had participated/graduated.

Mr. Gleason asked what Ms. Waters’ vision was fo= r the Town forest management in the next ten years. Ms. Waters said the Town would be = more built out and the areas designated as Town forest/conservation land would be critical. She envisioned prop= erly managed Town forest with management plans rotating every ten years that enhanced the wildlife and conservation area values; the properties would be open for recreational opportunities and were self-supporting/sustaining thr= ough timber revenues. Mr. Gleason = asked if the forestry program would interface with the Park & Recreation plan. Ms. Waters believed it would.

Council on= Aging Appointments

Mr. Danevich said the Senior Center Director Sue Hovli= ng had provided the Selectmen, for consideration, with a list of the recommended members for the Council on Aging.

Senior Cente= r Bus Request for Quotes=

Mr. Danevich said the intent was to have the RFQ befor= e the Selectmen; however, there were some delays in obtaining the specifics about= the bus. He said it was anticipat= ed to have the information by the end of the week.

Raymond Pa= rk Construction Contract

Mr. Danevich asked if all the Selectmen had the opport= unity to review the contract because he wanted to have a motion. Mr. Gleason said he reviewed the contract and was in favor of signing such; however, he recommended the dele= tion of Section 8 because it was not applicable. There were other minor changes sug= gested by the Selectmen. There was no objection to signing the contract. Mr. Danevich signed the contract (with the changes discussed) and ha= nded it to Ms. Gallant who was acting as agent for the Town.

Tallant Road<= /st1:PlaceName> Bridge Agreement and Notice to Proceed in Signing

Mr. Danevich said the Selectmen had the opportunity to review the contract and wanted them to take a position on it by signing such. There was no objection.= Mr. Danevich signed the contract on behalf of the Selectmen and handed it to Ms. Gallant who was acting as agent for the Town.

Update re:= cameras in cruisers

Mr. Danevich said the Police Chief provided the Select= men with a quote for the total equipment $21,736; the Board had previously appr= oved $20,804. He said the Board sh= ould decide whether to sign on for a 2, 3 or 4 year maintenance contract (quote = for such was provided). He asked = for an amendment on the motion (where $20,804 was approved). It was noted that the maintenance contract was transferable. Th= ere was a consensus to choose the three-year maintenance contract. The system is called the Digital Eyewitness NXT System (with DVD interface) which provides video recording (and other features).

Transfer S= tation Trash Hauling Award

Mr. Gleason said the Transfer Station Superintendent B= ruce Mason went out to five different companies and had them bid a multiple package. Based upon all the d= ata, Waste Management was the low bidder in every instance. Waste Management’s bid was $278,530 (the total bid for three-years will be $861,594).

Mr. Domenico said as the Town consolidates with the School District, he suggested that Mr. Mason have a clause within the contract that indicates should the Town expand the servic= es the Town would not be bound by the pricing. Ms. Gallant pointed out that the T= own had worked with Waste Management for many years and Mr. Mason believes that they would continue on. Mr. G= leason said Mr. Mason was pursuing to draft an overall Town plan.

(Gleason/Lynde) To authorize Transfer Station Superintendent Bruce Mason to proceed with the award of the contract to W= aste Management for a three-year contract for the needs of the Transfer Statio= n in tipping and hauling of all materials (they were the low bidder).

Fire Chief= Job Description

Mr. Danevich said the Town was actively in the process= of conducting a search for a Fire Chief. Mr. Domenico discussed proposed amendments to the job description. Mr. Danevich asked if the Fire Chi= ef had the opportunity to review the proposed changes. Mr. Domenico said the Chief was in= cluded on the distribution list. He = said he would have the updates made to the document so the Selectmen could do a final review.

Junkyard O= rdinance Revision Discussion

Mr. Domenico said Attorney Rattigan provided significa= nt comment and suggested unless there were objections, the document could be revised and re-circulated to the Selectmen. Mr. Gleason reviewed the comments = and requested that clarification be made to some.

Mr. Danevich noted that the voters would decide whethe= r or not the proposed Junkyard Ordinance would be enacted. Given that fact, Mr. Danevich told= Mr. Bergeron he would be welcome to participate in the discussion.

Mr. Bergeron said in the past, he had always recused h= imself from license applications (either his or others). He informed that he had owned/oper= ated a recycling yard since 1969. He= said he didn’t recuse himself this evening because the Selectmen were work= ing on a Town policy, which he was elected as a Selectmen to do so; this wasn’t in connection with his personal business. There was no objection to Mr. Berg= eron remaining seated with the Selectmen.

There was a brief discussion regarding the items conta= ined within the proposed ordinance. The Selectmen will revisit the ordinance in the May/June timeframe.

Mr. Bergeron said there was a law introduced in 2003 w= hich passed and became law in January, 2004 which he provided to the Selectmen.<= span style=3D'mso-spacerun:yes'> He discussed the bill, which addre= ssed parcels that had more than one unregistered car and the associated legal ac= tion for not complying. He said th= e law helped to clean up any city/town in the state. Mr. Domenico questioned if someone= would be in violation of the RSA if they didn’t submit their application by April 1^st. Mr. Ber= geron answered yes. He said technic= ally, some that had not been given a license after applying by April 1^st wo= uld be in violation.

Mr. Domenico will incorporate all comments submitted by Attorney Rattigan so the Selectmen would be able to have a better ‘re= ad' of the document. The Selectme= n will discuss at a later date given the fact that the ordinance would go before T= own Vote.

Three Year= Plan Review

Senior Center – Mr. Danevich said the pl= an was basically regarding expansion, which was a pressing problem. Mr. Lynde asked if a broader scope should be reviewed= .

Mr. Danevich said the goal after reviewing each of the department’s three-year plans was to pull together a master plan for = the Selectmen/Town to be able to measure itself.

Park & Re= creation – Mr. Danevich said most of the items were already coming to frui= tion given the newly submitted 7-year plan.&nbs= p;

Planning Depa= rtment – Mr. Danevich said the Planning Director had an ambitious plan a= nd was happy to see the ideas captured on paper.

TOWN ADMIN= ISTRATOR / SELECTMEN REPORTS

Ms. Gallant said the auditors were conducting a pre-au= dit; next week (Tuesday) the full audit would begin.

Mr. Domenico said he attended his first Planning Board meeting and outlined what was discussed.&n= bsp;

Mr. Bergeron had no report, but wanted to let Mr. Dane= vich know that he enjoyed serving under his chairmanship and congratulated him f= or being appointed chairman again.

Mr. Gleason had no committee report, but noted that he planned on attending the session in the Town Center with the Planning Department on Thursday, 9:30am.

Mr. Lynde said there had been a joint Forestry/Land Stewardship meeting which was well attended (including the Fire Chief and Forester Dan Cyr). He said Mr= . Cyr had mapped out the five new parcels and was preparing a management plan for each. He believed Mr. Cyr wou= ld come before the Selectmen in May/June to discuss further. Mr. Lynde said on Sunday there was= a meeting at Raymond Park with Granite State Soccer, Tim Greenwood (travel soccer); they were interested in possibly joining with the Town for construction of additional fields; there was a need for 4 regulation fields= and 4 smaller fields. He said it = was an opportunity and would keep the Selectmen informed. Mr. Lynde said there was a company= that did aerial photographs (at an angle to see structures) which would help document parcels.

Mr. Danevich said the Selectmen had made a decision (in 2004) to close the Castle Hill Road Bridge road during construction of the Tallant Road Bridge. He said the Windham Selectmen woul= d like to meet this Saturday at the Castle Hill Bridge to possibly reconsider whether or not to close the bridge. He said he invited the Police and = Fire Chiefs. There was no objectio= n to posting a meeting (at the Castle Hill Bridge 8am) and convening with the Windham Selectmen. Mr. Danevich noted the upcoming me= eting dates.

There was a brief discussion regarding fencing (for Lyons Park) and where the funds would come from (either Police, Park & Recreation or another line item). The Selec= tmen will discuss further when Mr. Gaydos was available.
