APPOINTMEN= TS

Bob Blinn = – Little League Opening Day

Mr. Blinn invited the Selectmen to Little League openi= ng day on May 1, 2004 at 9am. He asked that the Selectmen sign f= ive baseballs to be thrown during the opening ceremonies. He informed that the dugout roof t= hat had been vandalized was now repaired. He said that they had clean up day and everything inside the fence w= as done. Mr. Blinn said he had s= poken with the Police Chief due to the number of people expected on opening day.<= span style=3D'mso-spacerun:yes'>

Mr. McDevitt thanked Mr. Blinn and all the volunteers = for their work.

Public Hea= ring: Hazard Mitigation Plan – NRPC Regional Planner Steve Wagner, will pre= sent

Fire Chief E. David Fisher said a program had been sta= rted about one year ago. He said p= art of the presentation would be an acceptance/approval request so the information could be forwarded to FEMA. <= /p>

Mr. Steve Wagner, Regional Planner with NRPC met with = the Selectmen to discuss the Hazard Mitigation Plan which culminated from the Federal Disaster Mitigation Act of 2000.&n= bsp; He said NRPC worked with the state and FEMA to come up with plans and eventually they would complete the whole region.

Mr. Lynde arrived.

Mr. Wagner said there had been minor changes. He said under the FEMA contract th= e Town was asked for review before it was sent on to FEMA. Mr. McDevitt confirmed that there = was a two-step process; 1) to accept the plan as prepared by NRPC; 2) after formal review, have a formal adoption using the form provided. Mr. Wagner answered yes.

Mr. McDevitt asked Fire Chief Fisher if he recommended acceptance of the plan. Fire = Chief Fisher said a lot of work had been done on the plan and highly recommended = its acceptance. Applications for = grants are another primary reason for having an accepted plan in place.

Mr. Bergeron asked how much time had been put into the plan. Mr. Wagner said the pro= cess took a few hundred hours over the past year. He believed the cost was covered t= hrough state grant monies.

Mr. Danevich asked how the plan would benefit the Fire Department. Fire Chief Fisher= said situations had been identified and they where looking at what could proacti= vely be done to minimize the problems for protection. Mr. Danevich asked if there were a= ny new hazards identified in the process. Mr. Wagner said if circumstances changed in Town the plan could be amended. He used the lightning event of last year as an example of how an incident could be used to revise= the plan and mitigate future problems. Mr. Danevich asked if an electronic version of the document could be provided. Fire Chief Fisher believed once FEMA accepted the plan it could be provided electronically. Mr. Wagner agreed that it would be better to post the document once it was accepted by FEMA.

Mr. Lynde wanted to know how the proposed mitigation strategies were incorporated into the plan. Mr. Wagner said the items in the p= lan could be reprioritized as the Town saw fit. Mr. Lynde said one item of interes= t was the items dealing with Ma= nchester Airport and the FAR= 150 noise study. Mr. Wagner said = he could obtain additional information and pass it on.

Mr. McDevitt said the Selectmen could either accept th= e plan this evening, or review for a later meeting.

Mr. Wagner asked if a memorandum of approval could be forwarded so they could submit to FEMA.&nb= sp; Mr. McDevitt asked the Fire Chief to provide a memo stating the acceptance of the plan to Mr. Wagner.

Don Ware &= #8211; Pennichuck Water Co. – Discussion of Future Water Distribution Plans<= o:p>

Mr. Don Ware of Pennichuck Water Co. met with the Sele= ctmen to discuss the possibility of expanding their storage facility to increase = fire protection and future build out. He said Pennichuck had begun research of available land, begun discussions with state forestry and found out that the land being reviewed was designated as resource protected. Mr. Ware = showed a layout of land in the Co= llins Way (near Longview/Meadowview) area where they believed a tank could be sited off the proposed cul-de-sac near the forested area. He said there were curr= ent discussions with the developer to purchase the lot. He said the project was qualified = for funding though state revolving loan fund money (currently at approximately 2.8%). He said if the lot cou= ld be purchased, it would follow the normal planning board process. He said the long-term plan was to = have a bigger main to be able to provide water in from Hudson and provide expanded service in = Pelham.

Mr. McDevitt asked what the lot number was for the pro= posed area. Mr. Ware said the lot w= as ML 4-139-22. He said that the ro= ad was being ‘roughed’ in now and their timeline would be to meet with= the planning board this winter and begin construction in the spring of 2005. He discussed the current system, w= hich was currently underground. The proposed storage tank would be 50ft diameter x 24ft. in height; with the no= rmal tree cover of the lot, the tank would not be visible.

Mr. Bergeron asked if residents would be able to purch= ase the water. Mr. Ware said ther= e was a current distribution system the additional storage would more than double= the currently stored water. Mr. Bergeron asked if the storage was solely for larger water supply for fires,= or available for purchase by new customers.&n= bsp; Mr. Ware said the limits were the supply capabilities. The long term plan was to bring in= a supply of greater quantity from Hudson to distribute through the new subdivisions in the area. Mr. Danevich said during his time = on the Planning Board it was noted that one of the problems in the proposed area w= as water quantity.

Mr. Gaydos asked what the size of the tank would be. Mr. Ware said the tank would be 35= 0,000 gallons (per the state sizing criteria.&nb= sp; Mr. Gaydos wanted to know about the future demands on the tank and w= hat would happen if the residents used the storage capacity. Mr. Ware discussed the state crite= ria for water demands and how the capacity would be designed for the potential service area. He said space w= ould be reserved to add a tandem tank, if needed in the future. He noted once the tank was install= ed there would be very little maintenance needed. Mr. Ware also noted that it would = take an act of legislature to use land within the state forested area. He said the builder was concerned = with lot value, therefore Pennichuck was looking to purchase the lot, build the tank= and then resell the lot with an easement on it.

PUBLIC INPUT

Mr. Bob Francis, Jeremy Hill Road wanted to know how the impact of Nashua trying to p= urchase Pennichuck Water Co. affected day-to-day operations. Mr. Ware said he was responsible f= or the day-to-day operations of the water companies to meet the customer’s n= eeds. He said Pennichuck needed to move forward with planning regardless of the outcome with Nashua. He said they wanted to meet customer’s needs with both water quality and quantity.

Discussion= of Action Plan to Study of Future Fire Station Locations

Fire Chief E. David Fisher met with the Selectmen to s= peak in general regarding what the Fire Department was doing and what they were looking to do in the future. = He began by informing that a check had been received from the state and was be= ing presented to the Selectmen in the sum of $28,987.42 for the snow storm last year in connection with the removal costs and emergency services. Mr. Gaydos said he would review if= the money was to be placed in the general fund, or if it would be reimbursed back. Chief Fisher described = the department involved in the snow removal during the storm. He explained what items were reimb= ursed through the funds. He said in the pas= t the reimbursements had always been returned to the general fund, which sometimes placed constraints on a department’s budget.

Mr. McDevitt asked the Fire Chief to speak to Warrant Article 21 (raise and appropriate $19,450 for the purpose of studying the n= eeds and feasibility of constructing fire stations), which did not pass. Chief Fisher felt that the article failed because the people in the Town understood the need for new stations,= and were more concerned with trying to get it done, rather than conducting stud= ies. He said the first need was to put a substation in the Mulberry Lane/Ledge Road area near Harris’ Inn. = He circulated a photo of what would be proposed; a two-story structure with fo= ur bays. The second floor would = be used for training and meeting space. Mr. McDevitt asked if a study was needed to determine the optimal location in that area for a substation.&nb= sp; Chief Fisher said they knew where they wanted to put the substation = and had the reasoning, and interlocking streets. He said the Fire Department had discussions with some of the residents who had concerns with locating a fire station in the area. He discu= ssed the reasons for locating a fire substation in the <= st1:address w:st=3D"on">Mulberry Lane area. Mr. McDevitt said at some point the Selectmen should review the location for approval so that residents could be informed.

Mr. Lynde preferred a study that analyzed the area wit= h a locus map that said where the best location would be. Chief Fisher said without the warr= ant article, they wouldn’t be able to get anyone to do the study for noth= ing. He said the plans were, once the substation and central station were discussed to put another warrant articl= e on the ballot next year which would allow them to finish and study everything. He said over the = years they had discussed a substation in the Spring Street area, part of which was through a plan put before the Planning Board. He said they were taking a step fo= rward and explaining to the Selectmen what they would like to do and were willing= to listen to what the Selectmen would like them to do. Mr. Lynde understood that there we= re people with expertise within the Fire Department that could do the analysis= as to the station needs and response time. Chief Fisher said that information = was part of the study, however they had people they felt comfortable with what = they were doing. He said they were= very confident with the small station on Spring Street, but felt that studies ne= eded to be taken regarding a central station (either to keep the existing, or co= nstruct a new building).

Mr. Bergeron asked what time would be saved with a substation in the Mulberry= Lane area. Chief Fisher said the c= losest fire station in Dracut had the same response time as from the current station in Pelham. He said the Town had mutual aid wi= th Methuen, Dracut and= Salem. He said the Fire Department could = save approximately ten minutes with a station close to the Spring Street area. He said per the new national stand= ards an engine company should be on the scene within four minutes and a full fledged attack team within eight minutes; currently, in good weather response time = to some areas on Spring Street take seventeen minutes. Chief Fisher strongly urged the Selectmen to move forward with a substation this year without delay. He explained they were proposing t= o have one engine and one ambulance with call personnel manning the substation; the estimated total cost for construction, engine and ambulance was 1.2 million= .

Mr. Bergeron asked if there would be a survey of the t= ype of calls (i.e. medical) for the area over the past year. Chief Fisher said that factual information would be provided. Mr. McDevitt asked if NRPC would be able to provide additional information to h= elp make a determination. The Sel= ectmen did not object to Chief Fisher asking NRPC for information.

Chief Fisher said that the Fire Department was only lo= oking at one substation right now. = He said there were two options to be studied regarding a main station: 1) loca= te a main/central fire station on the empty lot near the library at the Village Green; the station would have two stories and have eight bays to accommodate future expansion for twenty years; the estimate cost to move into the build= ing would be three million dollars. Mr. McDevitt questioned the amount collected for impact fees. Chief Fisher was unsure of the exa= ct figure, but believed the amount was approximately $500,000. He said the second option was to k= eep the existing building, build a second floor for an estimated cost of 1.5 million. He said he needed direction regarding which option to move forward with based upon not knowing what would be happening with the traffic in the Town Center. He didn’t want money to be p= lace into a building with an unsure future.&nbs= p;

Mr. Danevich was concerned with the amount of equipmen= t exceeding the current facility. He was interested in moving the central fire station out of the current location to free up traffic patterns. He = said he would like to see the fire station expand and move to a different location. Mr. McDevitt noted = that the Municipal Building Committee had reviewed the possible other uses of the additional land beside the Library and noted that it could be used for a fi= re station. He suggested that the Selectmen vote in the next few weeks to provide the Fire Chief with directi= on.

Mr. Bergeron said the current building was built in 19= 72 and had served the Town well. He = said with the Police Department moving out the building may have sufficient room= for several more years. He said s= ome residents had commented that they didn’t want another fire station. He said the building may be able t= o have renovations.

Mr. Derby said the Budget Committee had discussed bond= ing and questioned if the Town would over-expend on bonding. He said for all intents and purpos= es a substation would be to the resident’s benefit, but he didn’t kn= ow if it would be every day if the Fire Department was at a maximum capacity w= ith calls.

Chief Fisher ended by saying at this time there were no funds to do a study of needs for additional substations. He said certain calculations had b= een done regarding response times and noted that Windham was looking to construct a fire station off Mammoth Road. He explained if Windham added a station, Pelham may be = able to use ‘line-boxes’ with regard to Windham responding to certain areas of = Town.

Chief Fisher said the Fire Department would like to cr= eate a presentation package to the Selectmen and Town for a substation in the Ledge Road = area as well as a future proposal for a central station. Mr. McDevitt suggested having NRPC involvement in the overall study.

Mr. Bergeron asked if emergency medical mutual aid was something the Town had used. = Chief Fisher said that the Town had a very strong mutual aid system for ambulance, fire and rescue. Mr. Bergeron= asked for an explanation of the mutual aid process. Chief Fisher discussed the standard operating procedure for utilizing mutual aid.

Mr. Lynde wanted to know how the eight-bay station had= been determined (i.e. population). Chief Fisher said the eight-bays was based upon future expansion as well as per t= he Town rules/regulations and the current amount of vehicles. Mr. Lynde discussed response time = and said he was concerned that decisions were being proposed without sufficient insight to the Town’s future needs.&= nbsp; He wanted to know if the Town had been mapped with response times to better understand where substations should be located. Chief Fisher said a map of the Town showing response times had been done awhile ago. It was noted that the map didnR= 17;t show optimal locations for substations, but the Fire Chief believed the map could be used as a foundation for creating such a map.

Main Fire = Station: Review and BOS Approval of Work

Fire Chief E. David Fisher provided an overview of the= plan for the existing Fire Station and what the final outcome would be irregardl= ess of what the final outcome would be regarding the building. He discussed what alterations had = been made to the building from the time that the Police vacated the space. He said if the decision was made f= or the Fire Department to leave the building virtually everything was movable. Chief Fisher explained the current ‘living’ space and discussed how the alterations would accommod= ate the firefighters as well as creating a communications area. He said if the communications area= were created, the federal government would grant $30,000 for its construction (t= he funds have been granted to the Town, but not yet received). Within the communications area, th= e Fire Department could create an Emergency Operation Center (‘EOC’) that would be portable if necessary.

Mr. McDevitt said that the Selectmen would have further discussion regarding the substations and the response from NRPC in connecti= on with such.

Chief Fisher circulated photographs of the current building. He discussed the pr= ojects done with Homeland Security Grants that had been received. He said they wanted to apply for a prevention grant in the amount of $27,000 (for materials). He ended by reviewing upcoming eve= nts: April 22, 2004 – table top exercise at the Police Station in conjunction with the Homeland Protection (paid for by the Federal Government); April 22, 2004 – second start o= f the CERT program; May 13, 2004 – Pelham High School Intersection project = (Mr. Bergeron volunteer to be the Selectmen Representative); project; May 28, 20= 04 – major mock incident; June 5, 2004 – Citizen’s Fire Acad= emy Day at Yarde Metals. Chief Fi= sher and Mr. Gaydos will work to create a calendar system for tracking dates.

OLD BUSINE= SS

Appointmen= t of Clerk – Town Clerk/Tax Collector Office

Update on = CMA Engineering at Raymond Park

Mr. McDevitt said there had been an issue with buried = tires and some alleged pollution at Raymond Park. He said that CMA Engineering had b= een engaged to help with preliminary work.&nbs= p;

Mr. Lynde said a meeting was held at the site with CMA= to view the area and other portions of Raymond Park. He said CMA would review the data = and discuss a path forward with the Department of Environmental Services. Several of the tires that had been buried were at the surface; the tires dated back to approximately 1960̵= 7;s – 1970’s; the rims were pre-disc brakes. A report would be forwarded in ear= ly May. The classifications by t= he state for things in the ground are treated different pre-1981 and post-1981. Mr. McDevitt asked= about initial concerns regarding pollutants.&nbs= p; Mr. Lynde said he didn’t see any evidence of pollutants (other than tires and rims). He beli= eved because of the age of the tires any pollutants would have either dissipated= , or would be contained on site. H= e said other areas were reviewed and there was some erosion from rain which would = need to be addressed. Mr. Lynde sa= id there was an issue with Coombs Junkyard storing tires on top of the ground,= and noted that the tires in the ground were of a different vintage. He believed when the Town acquired= that land it had already been filled.

Mr. Danevich asked what the sense of urgency was for correcting the situation. Mr.= Lynde said the engineer would go at a pace to try to resolve the situation. He said they were waiting to find = out what the state required. He s= aid it would however affect the plans for the recreation of the fields. He said that the Park & Recrea= tion Advisory Board would begin to consider a contingency plan. Mr. Danevich noted if the tires ha= d been dumped pre-1981 there wouldn’t be MtBE present. Mr. Lynde said that MtBE had been = added to gasoline in the early 1990’s and became an issue in the late 1990’s. Mr. Gaydos was hopeful that the next update would be in early May.

Mr. McDevitt asked if there should be concern regardin= g the access road. Mr. Lynde didn&#= 8217;t feel that the road would be affected because the road was planned to be in = the location of the trolley track bed. Mr. McDevitt asked if there was a plan in place to address some of t= he questions with the park (i.e. irrigation, roadway). Mr. Gaydos said the two problems t= o be addressed immediately are the potential pollution and the erosion within the park. Mr. Lynde said the futu= re plans called for a one-two acre pond, but alternatives should be discussed = with the new Park & Recreation Director to solve the water problems.

NEW BUSINE= SS

Bidding Po= licy for Recurring Contracts

Mr. Danevich believed that the Town was inconsistent regarding awarding bids and questioned what and how they should be done. Mr. Bergeron believed he had a cop= y of a bid policy dating back to 2001. Mr. McDevitt said the policy may not speak to the frequency in which bids were awarded. Mr. Gaydos said some= times bids were not in dollars, but rather in qualifications. He explained how certain bids, dol= lars versus qualifications, had been awarded in the past. Mr. McDevitt said a ‘sunset&= #8217; clause should be added to certain contracts if they currently did not conta= in such. There was further discu= ssion regarding the type of bids that the Town awarded. Mr. Gaydos believed that a discuss= ion between a couple of the Selectmen and Administration may help answer the question as to how certain bids were awarded. Mr. Bergeron suggested reviewing the manifests and categorizing the different services. Mr. Danevich said he would like to create a running list of contract items that are awarded on an annual basis= .

Mr. Lynde noted that there was a ‘dollar value&#= 8217; bid policy in place. He said ‘services’ was possibly a grey area. He said that central purchasing ha= d been discussed in the past by the Budget Committee.

Mr. McDevitt asked Mr. Gaydos to have the Office Manag= er (Judy Costigan) compile a list of the top ten, or fifteen vendors the Town = had paid money to over the past year. It was suggested to have more than just ten, or fifteen vendors listed. Mr. Gaydos was asked to list as ma= ny vendors as he could on a piece of paper.&n= bsp;

Public Gro= unds Maintenance Contract Award

The Selectmen had received copies of the bids. Mr. Gaydos discussed the bid items= that had gone out regarding grounds maintenance. He said the included a bid option = for an extended contract for either two, or three years. He reviewed the submitted bids fro= m the three companies who forwarded information.= Mr. Gaydos said the bids had been reviewed by Little League representatives Bob Blinn and Andy Vanti, as well as Mr. Bergeron. Mr. Gaydos recommended awarding the public grounds maintenance contract to Boyden Landscaping and asked that the Selectmen consider a two, or three-year contract. The basic bid for the first year b= eing $42,450; the second year being $43,100 and the third year being $43,750. Mr. Gaydos said that there were ad= ders such as the Village Green that could be later considered.

MOTION:=

(Derby/Lynde) To award a three-year bid contract (en= ding December 31, 2006) for the Public Grounds Maintenance to Boyden Landscaping, subject to the work, and if it fails the Town may opt out.&nb= sp;

Mr. Gaydos indicated that some contractual ‘outs’ had not been discussed by all bidders and said such lang= uage would have to be added. He no= ted that the Town would go out to bid in the fall of 2006 for the subsequent year(s).

TOWN ADMINISTRATOR’S/SELECTMEN’S REPORTS

Mr. Gaydos said there was a meeting with Breadloaf reg= arding the Village Green and discussed how to proceed. He said Breadloaf would submit how= they intended to proceed in writing. He said a notebook would be created to track any grants that had been applied = for and would be available for review. He also noted that a calendar would be created for the priority items identified by the Selectmen. = Mr. Gaydos said the final baseball agreement had been completed and was being reviewed by Mr. Bob Blinn and Mr. Andy Vanti, which would then be submitted= to the Selectmen for signature. = He reported that a memo had been put out to the Department Heads requesting th= at they submit an outline of their overall budgets by June 11^th for Selectmen review. Mr. Gaydos = ended by saying two resignation letters had been submitted. The Selectmen made the following m= otion:

Mr. Lynde wanted to further discuss the actions to be = taken by Breadloaf regarding the Village Green.&= nbsp; He said they were proposing installing a sprinkler system, at their cost. He said they would also= do a treatment for the crabgrass and would use sod for areas around the building. Mr. Gaydos said the= Town was awaiting the agreement in writing.&nbs= p;

Mr. Lynde said that the Forestry Committee had met, re= viewed all of the forested areas and made plans to update the Forestry Plans; two = of which are due this year – Muldoon and PVMP. He also said that the Park & Recreation Advisory Board had met and discussed the basketball courts with = the Police; there was an agreement to proceed.= He said Raymond Park was also discussed in connection with the tires= and the addition of a pond. He sa= id there was a request for no parking signs on Mammoth Road at Muldoon Park. He ended by informing that the Park & Recreation Director would begin work on the first day of summer camp registration.

Mr. Danevich said he had discussed the status update o= f the CLD invoices. Mr. Gaydos said= some actions would be discussed during non-public session, but noted that a lot = of the issues had been resolved. Mr. Danevich asked if there was an update regarding the issues with Tina Avenue= . Mr. Gaydos believed that the infor= mation was being researched. He said= that DES indicated that the work be stopped, but had indicated permission for certain work (in specified areas) to be done to mitigate any further erosion. Mr. Danevich asked if there was resolution regarding the ownership of the parcel. Mr. Gaydos said there had not been= a resolution; the individual believed they had a valid deed, but had been put= on notice that there was question regarding the validity of the deed. There was a growing consensus of t= he Selectmen to not sign the intent to cut form.

Mr. Derby said the Budget Committee had elected office= rs.

Mr. Bergeron said on, or about April 14^th o= ne of the Nashua Aldermen had sent an e-mail informing that three towns had voted= to approve the Charter. He asked= that the Selectmen add an agenda item to see if the Town would vote to approve t= he Charter and join the district. He said the next Joint Loss Safety Meeting would be held April 21, 2004 at 10am in the conference room at the Municipal Building with a subsequent meeting= for May 19, 2004.

Mr. McDevitt said the Selectmen should set an addition= al meeting to review priority items and asked that a date be decided. He informed that the Pelham Commun= ity Theatre Group wanted to know if they could schedule performances in Sherbur= ne Hall on June 25^th – 27^th. The Selectmen asked Mr. Gaydos to coordinate the hall use with the theatre group.
