Tallant= Road= Bridge Closing – Public comment

Mr. McDevitt said at a previous meeting he had reques= ted that people contact the Selectmen if they had comments regarding the closi= ng of the Tallant Road Bridge during construction; people forwarded their comments (see attached).

No one stepped forward to provide public input.

Mr. Gaydos said one of the discussions in connection = with closing the Tallant Road Bridge was the impact to the To= wn Center. He said he had worked with Police= Chief Haglund regarding alternatives; one of which would be to conduct a traffic count (with NRPC’s help). The key to the traffic count would be the peak hours during the day.

Mr. Bergeron said he would be meeting with NRPC Execu= tive Director Steve Williams (on a different issue) and wanted to know if he sh= ould ask him if there were people (at NRPC) to help conduct the traffic count.<= span style=3D'mso-spacerun:yes'> Mr. Gaydos felt all options shoul= d be explored. Mr. Bergeron said = he would ask Mr. Williams if help could be provided and at what cost. Mr. Lynde suggested that the turn= ing direction also be reviewed, not just the traffic count.

Mr. McDevitt questioned how many people with flags wo= uld be needed if the bridge remained open. It was not believed that traffic would back up on Mammoth Road if the bridge were ke= pt open, therefore, two people with flags would be needed, at each end of the bridge. Mr. Gaydos noted tha= t there would still be a need for a flag person at the center of Town. Mr. McDevitt asked that the infor= mation be obtained from NRPC forwarded by next week.

Basketbal= l Court Naming

Mr. McDevitt began by requesting that any information provided to the Selectmen should also be shared with the Park & Recrea= tion Advisory Board. He said that= there was a proposal to name the basketball courts in honor of Police Officer De= nnis Lyons. He said public input = had been received and was positive.

Detective Timothy Kelleher said the exact wording wou= ld be researched and brought back before the Selectmen.

Police Chief Evan Haglund showed the Selectmen a plan= that depicted the location of the proposed basketball courts. The Selectmen had been provided w= ith photographs of the area. Chi= ef Haglund requested permission to construct an 18ftx24ft shed to be used as = the storage facility for the basketball court, as well as certain police items (i.e. motorcycle, ATV). Ther= e would be no cost out of the budget; the funds would be provided though the Police Association and donations. Detective Kelleher said the alterations to the back field would not= be drastic, but would provide improvements.&= nbsp; He noted that the heavy equipment would possibly be brought in duri= ng July, 2004 to work on the basketball courts and requested that efforts to = lay out the skate board park be coordinated with Park & Recreation Board; therefore any work done this year wouldn’t be affected by subsequent= work to the surrounding area.

Mr. Lynde asked what the distance was between home pl= ate and the basketball courts. Chief Haglund said the left field line was 210ft. and the right field line went = out even further. Detective Kell= eher said the field would be geared toward smaller children.

Mr. Danevich asked if consideration had been given to= naming the area as a park in memory of Officer Lyons. Chief Haglund said they would be = very proud and felt it was a great idea. Mr. Danevich recommended that the whole park be named in memory of Officer Lyons. Mr. McDevitt = said to follow procedure, public comment would be kept open and the Board would vo= te next week.

Mr. Danevich said that the Skate Park raffle was going well and said there may be funds available to work with t= he Police Department.

There was no opposition to the plans being proposed.<= span style=3D'mso-spacerun:yes'> Mr. McDevitt asked that Chief Hag= lund inform the Park & Recreation Board so that everyone was kept in the loop.

Junkyard = Licenses – Public input – Bergeron, Mansur, Gendron =

Mr. Bergeron recused himself.

Mr. Lynde asked if the Coombs Junkyard had submitted = an application. Mr. McDevitt sa= id the Selectmen had not received an application.

Jack Mansur&= #8217;s Auto, 76 Dutton Road, Pelham, NH –

Mr. Dave Hennessey, 71 Dutton Road, asked the Selectme= n to ask each of the applicants if they were members of the new Green Yards pro= gram being done by the recycling yard operators of the state. He discussed what the program entailed. He also felt that = the applicant’s site (and off site) should have mandatory MtBE testing.<= span style=3D'mso-spacerun:yes'> He was hopeful that the Town Code Enforcement Officer would provide testimony that the sites were in complia= nce with the site licenses (filed with the Town) and there had been no additio= nal clearing.

Mr. Jack Mansur, 76 Dutton Road, said that Green Yard was a good program that he had been involved with since its inception. He said he was in compliance with them. He noted that his wate= r was tested on a regular basis with no problems and also informed that he had n= ot expanded.

Mr. Lynde asked how Mr. Mansur operated under the Gre= en Yard program. Mr. Mansur said the= Green Yard program was updating laws and standards to get everyone in compliance. Mr. Hennessey pr= ovided information to Mr. Lynde. Mr. Mansur said they were trying to work with the yards, rather than put them = out of business. He said the Fed= eral Government was making states responsible, and the states were making towns= be responsible.

Jean-GuyR= 17;s Used Cars and Parts, Inc., 180 Marsh Road, Pelham, NH –

Mr. Raymond Belleville, 176 Marsh Road, said he had spoken= with the Selectmen in the past about not issuing a permanent license to the junkyard. He said the Depart= ment of Environmental Protection (‘EPA’) tested fifty-one homes surrou= nding the junkyard; forty-eight of which had been found to have MtBE in their wells. He said the homes wer= e forced to use the contaminated value when refinancing, or selling. He did not understand how a perma= nent license could be granted when so many surrounding homes were contaminated.= He said he could name three insta= nces of non-compliance with the Town: 1) removal of pile of tires close to property line (Fire Chief had them removed); 2) installation of three monitor wells= by the dismantling plant as requested by EPA to be done in a three-month time= frame (which were done after a 30-day extension was granted); 3) EPA requested t= hat five bedrock wells be installed to monitor water flow which was to be done= in a three-month timeframe (30-day extension requested by Mr. Bergeron but was = not granted, the state had the work done; cost of which was $300,000, Mr. Berg= eron has now requested state funding). Mr. Belleville felt the site was a disgrace to the neighborhood and= said he did not approve of granting a permanent license.

Mr. Leo Thibeault, Simpson Road, reviewed a copy of the Stateline Express publication that cited a 2002 study which showed over 50% of the stateR= 17;s public water supply was contaminated.&nbs= p; He felt that Mr. Bergeron had done a good job in the approximate tw= enty years he was in business. He= said he was interested in purchasing a duplex on Carol Drive (an abutting property)= , that had been sold at a profit. <= /p>

Mr. Lynde questioned the percentage of water contamin= ation in the newspaper article. Mr. Thibeault read a portion of the article aloud. Mr. Lynde felt the key word was ‘public’ water supply, not residential wells.

Mr. Belleville questioned what the house number was o= n Carol Drive that Mr. Thibeault wanted to purchase. Mr. Thibeault said it was 4 Carol Drive.= Mr. Belleville informed that 4 Carol Drive was not listed as being contamina= ted, but 5 & 6 Carol Drive were listed as having contamination. He said his home had 170 parts of MtBE and the state standard was 13 parts of MtBE.

Mr. Chris Malloy, 7 Keyes Hill Road, said that the state tested between fifty-two to fifty-six wells positive for MtBE in the surrounding area. He said junkyards serv= ed very little purpose to the Town, but at a maximum liability. He wanted to know: 1) if all the required steps that the Selectmen and the Department of Environmental Services had been met; 2) wh= at additional steps had been taken to make good on the wells that were pollut= ed; and 3) did the junkyard qualify for the Green Yard program. Mr. Malloy said he was not agains= t a license being issued as long as certain steps were being met and there was= an honest try at fixing the problems. =

Mr. Jean-Guy Bergeron, 180 Marsh Road, discussed the Gree= n Yard Program and the fact that a representative (Ms. Pam Spreg) met with the Au= to & Truck Recyclers Association of New Hampshire (‘ATRA’) me= mbers (approximately five years ago) to seek volunteers to serve on the committe= e and obtain information. He said = there were two volunteers. He went= on to discuss the issues being reviewed by the Green Yard program. He said there was no official pro= gram yet, but municipalities were being invited for their input. He said the state was working har= d with everyone to make it a good program. Mr. Bergeron said he was a member of ATRA since 1979 and was the ch= arter president of the association. He then discussed the MtBE testing and said he had three filtration systems installed on his property, which was tested for MtBE both on the inlet and outlet every three months. H= e said he had worked with the state when he found out about MtBE. He believed the number of homes a= ffected was at one time around sixty. He said the levels had dropped considerably.= He said that there was contamination underground and in the ground = water system. He said people could contact either the Health Officer or DES to obtain additional information.= Mr. Bergeron ended by saying that= Washington may = be making a change. He agreed that MtBE should be taken out of the gas.

Mr. Lynde asked if Mr. Bergeron was part of the Green= Yard Program. Mr. Bergeron said h= e had attended almost all of the meetings, but they had not officially said he w= as a green yard yet. He received = a lot of information. Mr. Lynde as= ked Mr. Bergeron if he was doing the specific things they wanted recyclers to do.<= span style=3D'mso-spacerun:yes'> Mr. Bergeron answered yes and exp= lained what items Green Yard was concerned with.=

Mr. Lynde asked if Mr. Bergeron agreed that the state= found his yard as a source of contamination of the wells. Mr. Bergeron disagreed and said h= e did not know where the MtBE came from. He said a copy of the findings could be requested. Mr. Lynde asked how far along the groundwater remediation program had gone.= Mr. Bergeron said a company had come in and done three borings, lat= er, an additional company came in and did five borings. He said an additional company cam= e and removed soil, put in new soil; tests were being done every three months an= d the results were decreasing in the Marsh Road area.

Mr. Lynde discussed MtBE and the problems associated = with it. He said most contaminati= on was caused by gasoline spills. M= r. McDevitt believed that one cup of gasoline would pollute five million gall= ons of water.

Mr. Malloy believed that there needed to be accountability. He said as p= art of the work DES hired Environmental Consultant Roy F. Westin, to investigate = MtBE contamination in the Marsh Road area; based upon Mr. Westin’s report, DES determined that the primary source of contamination to the ground water was the auto dismantling facil= ity at 180 Marsh Road. He wanted to know where the infor= mation was from the testing performed every three months.

Mr. Belleville read aloud an article published in the= Salem Observer which stated Mr. Bergeron’s junkyard was a source of MtBE contamination in Marsh Ro= ad drinking wells.

F. Gendron a= nd Co., 11-13 Hobbs Road, Pelham, NH -

Mr. McDevitt provided a brief history. He said in 1999 the Selectmen did= not renew the junkyard license, the Town was taken to the NH Supreme Court whe= re the Selectmen were found to have acted correctly, there was now an applica= tion.

Ms. Joanne Tellier, Balcom Road, said she and her husb= and forwarded an e-mail, but failed to mention that the Federal Government had spent over one million dollars cleaning up Mr. Gendron’s property be= cause of his irresponsibility. She= requested that the Selectmen not issue a license.

Mr. McDevitt read aloud a letter submitted by Roland = and Marjorie Raza, who were unable to attend the meeting. Mr. & Mrs. Raza’s lette= r cited some of the reasons that the Supreme Court ruled in favor of the Town. They felt the Town had a legal obligation to not issue a license until such time as the court ruling was overturned and the stipulations outlined in the variance were met. The letter also cited the court d= ecree from 1998 in which the junkyard was to refrain from use of abutter’s property for any purpose what-so-ever; the Razas therefore requested the T= own enforce the decree and have the burm removed from their property.

Mr. McDevitt said on the advice of Town Counsel was t= o put the ‘ball back in his court’.= He felt it was incumbent on Mr. Gendron to demonstrate that he had remediated the things the Town found fault with at the time that the licen= se was not approved. He said un= less there was an objection, he would like Mr. Gaydos to send a letter to Mr. Gendron asking him to demonstrate the remediation.

Mr. Lynde wanted to know how the Town would have the = burms moved since they were on abutter’s property. He said another issue was the tra= ilers on the property line. Mr. Ga= ydos said the trailers had been registered.&nb= sp; He also noted that Code Enforcement Officer Roland Soucy had been working with Mr. Gendron. He believed Mr. Gendron should address the issues and show why he felt they w= ere not an issue. The issues wou= ld need to be researched to determine what actions could be taken by the Town.

There was no objection by the Selectmen to a letter b= eing drafted to Mr. Gendron requesting that he demonstrate to the Board that conditions= had changed such that a license should be considered.

Mr. McDevitt said a considerable amount of public com= ment was received regarding the junkyard licenses that he asked to be attached = to the minutes.

Mr. McDevitt discussed the junkyard license applicati= on process and what action the Selectmen could take. It was his understanding that the= state had very narrow reasons to which a license could be denied.

Mr. Lynde said that there was court actions/rulings o= n all the cases before the Selectmen. He believed the Town should find out the status of the state and how they sit= with Mr. Bergeron’s junkyard and grant a 90-day license.

Mr. Danevich echoed the concerns and noted that there= was no recent correspondence. He sa= id both the Health Officer and the Building Inspector concurred that the junkyard = had complied.

Mr. Lynde believed Mr. Mansur was in compliance and didn’t see any issues and made a motion to grant a license.

Mr. Danevich requested that the Selectmen review the information they were provided in connection with conducting periodic revi= ew of sites and items such as drainage. <= /span>Mr. McDevitt said that the regulation could be amended after holding a public hearing. He suggested that T= own Counsel review the policy. M= r. Gaydos said there was a federal storm water management program that the To= wn had to comply with and said any business would have to deal with it. He felt it was a complicated issu= e that could not be accomplished quickly. =

OLD BUSIN= ESS CONTINUED….

Appointin= g Town Hall Transfer Committee

Mr. McDevitt said that the Selectmen needed to take s= teps regarding the Warrant Article and the transfer of the old Town Hall to the VFW. Mr. Bergeron had previo= usly volunteered. There were no o= ther volunteers, so Mr. McDevitt said he would join the committee. Mr. McDevitt said the committee w= ould do only what the Selectmen authorized. He said an initial discussion would need to take place with the VFW. Mr. Gaydos said he was = in the process of locating the deed for the building.

Currier Road response to Open Forum question<= o:p>

Mr. Gaydos said there had been a question/concern fro= m a resident regarding signage, vehicles parked along the road, mud and debris= in the area and that the turning radius was too narrow forcing vehicles off t= he pavement. He said Planning D= irector Will D’Andrea has indicated that the signage was in place, there was= no trailer on the street and he did not observe mud or tree branches in the road. The turning radius was= approved by the Planning Board in 2003, however there is continuing discussion on t= he Planning Board. It was sugge= sted if residents have further questions, they should contact the Planning Director directly.

Board of = Selectmen Planning and Meeting date confirmation

Mr. McDevitt said that he had reserved the next meeti= ng for the Selectmen to discuss their planning list. He understood that the basketball= court naming should take place next week and asked that no controversial items be brought forward for the agenda next week.=

There was a brief discussion regarding the Selectmen = having an e-mail address through Pelhamweb. Mr. McDevitt informed that the Selectmen were aware that having discussions/making decisions via e-mail was not allowed.

Discussio= n of Contribution Regional Water District legal expense

Mr. Gaydos said there was a discussion last week rega= rding allocating $5000 to the Regional Water District legal fund. He said last year the Selectmen h= ad approved the funds, if available, subsequently the Budget Committee level funded the Town’s legal expenses.&n= bsp; He said at this point 1/3 of the legal funds had been spent.

Mr. Bergeron discussed the history of the water distr= ict and the formation of a committee made up of surrounding communities that had c= ome together to try and acquire Pennichuck Water because they understood the importance of having local control and maintaining the quantity, quality a= nd cost of water. He said there= had been numerous meetings and public hearings. The point came where it was felt = that counsel was needed; a firm was hired that had three attorneys as well as an additional attorney who had worked (for free) with the group from the beginning. Mr. Bergeron said= once all questions were asked, a charter should be in place. He said the Town could also have = the charter reviewed. Because the attorneys who have been working with the water district had to be funded, = Mr. Bergeron requested $5000 for legal fees.&= nbsp;

Mr. Danevich said he supported the funds last year an= d asked when the matter would draw to a conclusion. Mr. Bergeron said he had not hear= d of any other requests from individual towns.= He said if Pennichuck was acquired and funded with revenue bonds the money would be given back to the Town.&nb= sp; Mr. Danevich asked Mr. Gaydos if the legal budget would run short a= nd wanted to know what would happen if it ran out. Mr. Gaydos said by statute the To= wn could not spend beyond the bottom line and would have to review where else= the money could be taken from. M= r. Danevich said that this item was discussed at the Budget Committee and was cut. He asked what would hap= pen if it were denied. Mr. Bergeron= said he would report back to the water district that the Town denied the request. He said in defense = the Town would want to have a seat at the table in the future and noted that t= he Memorandum of Understanding had been signed. He said there had been a lot of w= ork put in by all the communities. <= /p>

Mr. Lynde asked if half the money could be approved n= ow and re-assess the situation in three months.&= nbsp; Mr. McDevitt let it be known that he was a customer of Pennichuck Corporation and said his vote would not affect his water bill.

Spring St= reet Betterment Assessment Values

Mr. McDevitt said a question had been raised at last week’s meeting regarding the calculation of assessed values to calcu= late betterment fees for the residents of Little Island Park, Spring Street Ext= ension, and Berthel relative to the change of those roads to Town roads. He read a portion of the Selectmen’s minutes from the October 28, 2003 meeting.

Mr. Ergendino Perrone, Little Island Park, said durin= g Open Forum at last week’s meeting he asked how properties would be evalua= ted to get a current value. He s= aid he had information on all the property values from the assessor’s offic= e and noted in particular that one property on the list provided by Mr. Gaydos w= as $100,000 less in value than they were in October 24, 2000. He said if the value of the prope= rty was going to be used, he wanted to ensure that the amounts were correct. Mr. Perrone didn’t believe = that the calculation method used was fair.&nbs= p; Mr. McDevitt said the Selectmen had discussed the issue numerous ti= mes ,and had made the decision with no opposition from the neighbors. He said the method would not be c= hanged. Mr. Perrone confirmed that the va= lues would be obtained from the Assessor’s office. Mr. McDevitt answered yes.

NEW BUSIN= ESS

Vote on T= own Administrator’s Contract

Mr. McDevitt said that the Town had and agreement wit= h the Town Administrator which had to be renewed annually. He said prior to this discussion = the Selectmen had performance review discussions. Mr. Gaydos reviewed the changes t= hat had been made to the contract from the previous year (the date and the rate of= pay).

The Selectmen signed the agreement.

Pelham Li= ttle League Agreement

Mr. Gaydos said in the past the Town had done one con= tract with Pelham Little League, and one with the Razorbacks, this year the Town would have one contract with both to better coordinate activities (i.e. pa= ying electric bills). He asked th= at the Selectmen review the contract for signature in two weeks (April 20, 2004).

Mr. McDevitt asked if Little League picked up the tra= sh throughout the park when utilizing the field. Mr. Gaydos did not know.

Naming Po= licy Committee, Purpose, Call for Members

Mr. McDevitt reminded the Selectmen that Judge Michae= l Jones suggested that the Town have a naming policy. He said there were ample items throughout the Town that could be named.&= nbsp; He asked if there were any objections to the formation of the commi= ttee and requesting that applications be submitted. There were no objections.

Mr. Danevich said an application had been submitted a= nd requested they be interviewed at the April 20, 2004 meeting. It was also noted that there were= two submissions for Alternate positions on the Conservation Commission that wo= uld also be scheduled for April 20, 2004.

Appointme= nt of Selectmen Representative to CIP

It was brought to the Selectmen’s attention tha= t a Selectmen Representative had not be appointed to CIP. Mr. Lynde stepped forward and volunteered.

Elmer G. = Raymond Park

Mr. McDevitt informed that possible pollutants had be= en discovered in Elmer G. Raymond Park. He said it was unclear at this moment what they were and where they= came from. He believed that steps= should be taken to investigate. Mr.= Lynde said he went to the site, didn’t see any pollutants, but did site so= me tires. There was a brief dis= cussion regarding what should be done at the site. Mr. Gaydos didn’t believe that testing would be a major project. Mr. Danevich discus= sed the simple samples that could be done and investigated further if contaminants= were found. Mr. Gaydos said he wo= uld move forward with the tire removal and then set up a meeting with the engi= neer to discuss the situation further. The Selectmen provided preliminary approved of $500 for testing the soils.

TOWN ADMI= NISTRATOR’S/SELECTMEN’S REPORTS

Mr. Gaydos asked that the Selectmen review the back of Sherburne Hall and the table set up. He said there was a breach of the Stonepost dam; the damage was min= imal; the developer is working with the state.&= nbsp; He ended by saying that the Men’s Softball League had met wit= h the Police Chief and come up with wording for the Men’s Softball agreeme= nt. He expected the agreement would be brought to the Selectmen in the next couple weeks.

Mr. Lynde said the Forestry Committee would meet April 17, 2004= . Park & Recreation will meet M= onday night.

Mr. Danevich said if anyone wanted tickets for April = Madness (April 16, 2004= ) they could purchase tickets at the Police Station. He ended by informing that the Skate Park raffle was going well and 180 tickets had been sold. He was hopeful that some funds wo= uld be available at the time the Police Department brought in the heavy equipment= for the basketball courts.

Mr. McDevitt informed that during the last rainstorm = a state of emergency had been declared in the event that there was damage in Town = so that federal reimbursements could be requested.

Mr. Derby had no report other than the Budget Committ= ee would meet to elect officers.

Mr. Bergeron said a resident had previously had quest= ions about the Town Report; he was told that information had been e-mailed to t= he printer, but not included. H= e said that residents had asked that sign be added to the new Town Hall. He informed that he met with the = Counsel on Aging and reported that an outside grill had been purchased, a new tent= was also purchased and ended by informing that the Strawberry Festival would be held June 26, 2= 004. He requesting that Executive Dire= ctor Steve Williams be asked if he was available to attend the April 27, 2004 meeting. Mr. McDevitt answered yes. Mr. Bergeron asked if Mr. Danevic= h had the opportunity to speak with the webmaster regarding a question he had at= a previous meeting. Mr. Danevi= ch said he had spoken with the webmaster but had not drafted a response yet. He ended by saying that the next Regional Water District Committee would meet April 29, 2004

Mr. McDevitt announced that the Library Director had submitted her resignation, and was now gone. He said the Sherburne Hall Commit= tee kicked off their capital campaign fund and in one week raised $11,000.
