ZONING BOARD OF ADJUSTMENT Site Walk

February 25, 2006

The Chairman, Mr. Peter M= cNamara, called the meeting to order at approximately 8:30 am.

PRESENT:

Peter = McNamara, David Hennessey, Svetlana Paliy, Planning Director Jeff Gowan, Conservati= on Commission members Glennie Edwards and Paul Dadak

Case #2340 LEMIEUX, Andre – 35 Irene Drive = / ML 40/6-185-37 – Seeking a Variance concerning Article VII, Section 307-41 (b) to permit keeping an existing building permit approved for a swimming pool & deck in it̵= 7;s present location and be able to maintain the existing lawn within the 50ft.= WCD area.

The extent of the WCD encroachment was reviewed by the ZBA and Conservation members present. Dave Hennessey suggested that since the owner bought the property with no WCD indications evident and with the pool and deck in their existing location, = that striking a new WCD line that would miss the structures but that would preve= nt any continued encroachment on the WCD for a “back lawn area” wo= uld be worth consideration. The consensus of members present was in agreement. A suggestion was made that a new line be drawn from 10 feet off the back of t= he home owner’s existing shed to the existing marker at the opposite sid= e of his back yard. This new line would be demarked by WCD signs, as well as sho= wn on a revised plan that would be recorded at the registry of deeds. Additionally, it was suggested that the owner amend his deed to reflect this change so future buyers of the property will know of the variance, if grant= ed, and the WCD restrictions.

A vote to confirm this co= nsensus will take place at the March 13^th BOA meeting.
